Blatantly Bias EC Chairperson

Another reason why we need to kick out the BN Govt!
TO CHANGE THE EC Chairperson to a more unbias person. Not to mention a more qualified person who is an expert in Election Rules!

25 FEB 2011
Election Commission (EC) chairperson Abdul Aziz Mohd Yusof refused to take a stand on whether dishing out 'goodies' in election campaigns flouts election laws.

NONEMet by reporters while visiting the Merlimau Polytechnic College, Abdul Aziz said that he was not an “expert” on the matter.

"I am not expert, we are not expert. There are court case also," he said.

This was despite that his commission having already conducted 12 general elections and scores of by-elections.

Abdul Aziz said this when asked about the mysterious 1Malaysia NGO, which surfaces during by-elections to organise dinner events and give out goodie bags which includes staple items such as tins of Milo, rice and condensed milk along with a poster of Prime Minister Najib Abdul Razak.

The 1Malaysia NGO's main target, the non-Malay voters, have been voting against BN in recent by-elections.

'Lu tolong gua, gua tolong lu'

Abdul Aziz gave a similar response when asked about Najib's “you help me, I help you” remark uttered during a function at a field next to SRJK (C) Merlimau on Feb 19.

"As I said, I am not expert. I can't say this is definitely corruption. I don't know. (You can) collect evidence leave it to the Malaysian Anti-Corruption Commission (MACC).

"I am not surprised if those who came for (free) food and get hampers are not voters.Let the agencies (who) specialises in this area check (the allegations)," he said.

"Campaigning has yet to begin. It starts tomorrow. Before that, it is not (considered) campaigning," he added.

NONEIt was reported bySin Chew Daily that Najib had told about 1,000 people gathered at the event that: “Lu tolong gua, gua tolong lu (You help me, I help you)”.

This was first uttered during the Sibu by-election. Back then, Najib had promised to implement flood mitigation works only if BN won the contest. In the end, BN lost its grip of Sibu with a wafer-thin majority.

In the case of Merlimau, while Najib did not make any specific promises, he asked the voters to list out their demands.

Abdul Aziz said that it was difficult to define election bribery, citing the Hulu Selangor election petition filed by PKR candidate Zaid Ibrahim, who has since left the party.
The Elections Court dismissed the petition at the preliminary stage.

"It's hard to prove, therefore it was rejected,” explained Abdul Aziz.

The remark by Election Commission (EC) chairperson Abdul Aziz Mohd Yusof that he "is no expert
" to judge whether the dishing out of campaign goodies flouts election laws has earned him more brickbats from civil society groups.

Election watchdog Bersih 2.0 chief Ambiga Sreenevasan cited specific laws to prove that EC has the power and responsibility to combat election corruption, and she decried that this has not been exercised by the EC.

On Prime Minister Najib Abdul Razak's "you help me, I help you" remark made during campaigning in at least two by-elections, Ambiga said this clearly came under section 10 of Election Offences Act 1954 (EOA).

This section defineNONEs inducement to voters during campaigning.

Ambiga said the EC has the responsibility to ensure that such incidents are brought to the attention of the authorities in order to ensure the free and fair conduct of elections.

However, Abdul Aziz (left)had refused to take a stand on the matter.

Although the power to prosecute lies with the Attorney-General's Chambers, Ambiga stressed that the EC must also do its part.

"The very least it can do is to lodge a police report," she toldMalaysiakini yesterday.

"Only then will members of the public believe that the EC is independent."

Najib had made the remark during the Sibu and Merlimau by-election campaigns, but Abdul Aziz has insisted that he is not an expert to consider this complaint.

"As I said, I am no expert. I can't say this is definitely corruption. I don't know. (You can) collect evidence leave it to the Malaysian Anti-Corruption Commission (MACC)," he had said when questioned.

bersih 21 charged in petaling jaya session court 230109 ambigaAmbiga (left) further pointed out that Section 115(2) of the federal constitution stipulates that 'all public authorities shall, on the request of the (EC), give the commission such assistance in the discharge of its duties as may be practicable'.

Added the former Bar Council president: "It also means the EC has to ask the public authorities to investigate the offences under the EOA. It has the responsibility to do this... the EC cannot wash its hands off the matter."

This is not the first time that the country's top election officer has appeared hazy when questioned about allegations of election-related corruption.

In an interview with Malaysiakini last July, Abdul Aziz said Najib's remark of "you help me, I help you" was not bribery because it had to be proved that voters had cast their ballot for the candidate because of the call.

Law losing its function

Ambiga also expressed disappointment that the role of enforcement teams set up by the EC during election campaigns has been confined to removing illegal and derogatory banners.

She reminded the EC that Section 27E(a) of the EOA empowers the enforcement team 'to patrol, and to monitor the activities of the candidates in its area of control to ensure that written laws relating to elections are being complied with' - and that this includes acts of corruption.

"NONEIf they (the candidates) don't comply, they must report it. The enforcement teams actually have the power to ensure compliance. They must show they mean business," said Ambiga.

The EC's paralysis, she said, has caused the EOA to lose the very function stated in the preamble of the Act - 'to prevent electoral offences and corrupt and illegal practices at elections'.

"In my recent memory, nobody has been charged under this law. What is the point of having it?"

Promises, not corruption

However, Transparency International (TI) Malaysia chapter president Paul Low took a different view of Najib's remark, saying that making election promises is not corrupt practice.

"If there is no exchange of money on the spot, it is just a campaign promise," Low said when contacted recently.

"It is very difficult to say this is corruption, as long as there is no handing over of cash. It is not clear-cut."

But he agreed with Ambiga that the EC does have certain powers under the current laws that are not being exercised.

"If they want, they can define what is election corruption. They can be independent, but they are not exercising it."

ti global corruption report 230909 paul lowLow (right) also pointed out that the election expenditure cap for candidates - RM200,000 for a parliamentary seat and RM100,000 for a state seat - is not effectively enforced by the EC.

"It seems that they have never investigated the expenditure cap after the candidates submit their accounts."

On election reform, Low suggested that the EC be given more teeth to define dos and don'ts during elections and the power to bring offenders to book, las is enjoyed by the MACC.

"In Thailand, the EC took the prime minister to court for over-spending."

Ambiga's and Low's wishes are not likely to be fulfilled, for Abdul Aziz in the interview with Malaysiakini had rejected any proposal to expand the EC's powers, saying the commission is "not Superman" to take up all tasks.

He wants the EC's main duties limited to managing and organising elections, preparing and revising the electoral roll and reviewing constituency boundaries.

If you can't win my reason, then try money!!

Recently Porn star Chua Soiled Lek made some stupid commence about the opposition candidate wearing gloves and not shaking hands with guys. I am not a Malay and I frankly don't think it is an important issue! In any case MCA has been going back on old issues to scare the Chinese with the Islamic state issue.

I think everyone in MCA is a dumb dinosaur! Don't they get it that those issue no longer scare the younger votes?!? Why can't they concentrate on real important issues like TBH case, the integrity of the candidate and etc???

Well I guess they went on to plan B!

Bribe the VOTES!! It is no surprise that Malaysian now call by-election, buy-election!!

This blatant act is terrible!!!

I hope the people of Tenang take the goodies but vote the opposition!!

The people of Tenang have been receiving windfalls since the by-election was called, including money and gifts from government agencies and related agencies, all claiming it is just business as usual. tenang by election hamper 230111 02BN representatives say the goodies are merely "regular assistance due to underprivileged residents" from the various government agencies. Regardless of the reasons given, how to receive "election goodies" has become the hottest topic in Tenang coffeeshop talk.

Malaysiakini interviewed several voters who had received such "assistance", based on tip-offs from the local people. A 40-year-old single mother residing in Labis, who requested she not be named as she feared reprisal, showed Malaysiakini a RM50 hamper, an ang pow packet with RM200 and 12 feet of fabric that she received in a function at the Labis municipal council hall last week. ""I don't know who was the organiser. I think there were more than 100 beneficiaries.

The organiser gave out RM200 cash, hampers and fabric. The cash was put in a white envelope,” she said. According to her, Labis MP Chua Tee Yong and Johor exco Tan Kok Hong of the MCA were present as VIPs and one of them called on those present to support the BN candidate. Tan when contacted denied that the goodies were from MCA, saying that they were provided by the Welfare Department. "This is not vote-buying. We did not do so. These activities are carried out by the relevant government agencies throughout the year. How can we direct the department around?" he said.

Cash for flags
Another female voter also claimed that her neighbour was given RM1,000 cash for putting up four BN flags and a banner with Najib's portrait in his house compound throughout the campaign period. tenang by election 230111 1 malaysia group distribute goodies 1Another woman voter said her neighbour was given RM1,000 cash for putting up four BN flags and a banner with Najib's portrait in his house compound throughout the campaign period. She said the kindergarten in which her nephew is studying has called parents to inform them that families earning below RM2,000 are entitled to RM450 cash.

However Malaysiakini could not verify this claim with the relevant authorities. However, ever since the by-election for Tenang was called, it has been observed that many government agencies have focused their programmes and assistance schemes in the constituency. Tenang - Shafie Apdal giving goodies to orang asliNajib, in his visit to Tenang on Tuesday, announced an allocation of RM1.31 million to upgrade all the mosques, surau and religious schools in the three Felda settlements in the constituency.
Yesterday Rural and Regional Development Minister Shafie Apdal also promised 20 new free houses to tthe people of two orang asli villages in the constituency. What makes this even more interesting is that MCA president Chua Soi Lek - who holds no government post - has also announced that Tenang New Village will get a new basketball court.

Meanwhile, Bernama reported today that Agriculture and Agro-based Industries Minister Noh Omar has dismissed the notion that the ministry's programmes in the Tenang state constituency were instant projects implemented because of the by-election.
He said the programmes were on-going, such as the ministry-with-the-people programme, which is held monthly. "For example, last year we had more than 15 programmes, none of which had anything to do with elections," he told reporters after launching a young entrepreneurs development programme at the Labis square in Tenang.

Deal or No Deal!

Below are words taken form the You Tube extract below

So kita ada deal, tidak?!
Ada ah!?...

Lu mau 5 juta kan?!?
Ah.... Lu mau 5 juta... gua mau Robert Lau menang!
Boleh tak?
Ahhh..... Lu tak payah keluar duit!
Gua kena keluar duit!
AH......Very expensive you know!...
Don't worry there is more for Sibu (6:00)

DOES THIS SOUND LIKE A PRIME MINISTER OR A SHADY PERSON TRYING TO BRIBE SOMEBODY?!?!!

If you haven't watch the You Tube video yet of Najib's blatant bribery attempt off the people in Rejang Park then you better watch it below.

The words came out from his own mouth!
There is no need for debate!
As Malaysian's please come out with your own conclusion on what type of PM we currently have!

Some highlights include...

Najib said "I want to make a deal with you!...Can we have a deal!...You help me, I help you!"
He continues to say..."If you deliver me Robert Lau... on Sunday, on Monday I will ask the cheque to be prepared." (0:56)

"This is our deal tonight! Robert Lau becomes Ahli Parliament on Sunday night, Monday I will instructed the cheque to be prepared! I dunno how much it cost? 3million? 5million!! 5 million ah!" (2:56)

"OK Lah! Robert Lau menang I ask the 5million to be prepared on Monday" (3:32)
Look at his hand gesture when he say "ok lah RM5million" It is so condescending!

Does Najib think that the people of Rejang Park is worth only RM5 million!

The arrogants PM talks like it is his own RM5 million to give!
Is that not the Rakyat's 5 million!

The worst comment was the one at 4:11.

Najib said, "I don't have to come here (Rejang Park).... This...This is not a place for a Prime Minister to come!"

But then he has the chick to say that he is the People's Prime minister! (5:10)

If he was going to bribe the people of Rejang Park, he should at least use his own money...Like maybe take the commission money he conned out of Altantuya!

WAIT! I think that was the Malaysian people's money too!

I guess Najis played DEAL OR NO DEAL with the people of Rejang Park and Sibu and lost!

I wonder it he is going to play the same game with them again in under one year's time when the Sarawak State election comes!

Latest from Sibu By-Election!

CONGRATULATIONS PEOPLE OF SIBU!!
You have made Malaysia proud!

Now I have a question to Najib!

Will you still keep all your by-election promise or will you now abandon all the 18,447 people who voted for you?!

10.55 pm: Its official! DAP won by a very slim majority of 398!

OFFICIAL FIGURES!
DAP - 18,845
BN - 18,447
Ind -232
Majority - 398

Official postal votes BN 2323,
DAP 70,
Ind 36.

Total ballots issued: 2827.
Rejected: 208.
Unreturned: 190

10.35pm: It appears that there was some minor dispute over the postal ballots. However, it is learnt that the Election Commission will be announcing the result soon.

10.15pm: At the main tally centre in Dewan Suarah, two SUPP officials are meeting with returning officer Wong See Meng. It is believed that they are discussing about the delay in the announcing of postal vote results. They are later joined by DAP officials Ng Wei Aik, Lim Lip Eng and Ronnie Liu.

It is still raining in Sibu. The rain began about two hours ago. Supporters from both sides, many of them holding umbrellas, are waiting calmly outside Dewan Suarah.

10.10pm: Election Commission chief Abdul Aziz Yusof tells Malaysiakini in an SMS message that the postal ballots Form 15 is on its way to the main tally centre in Dewan Suarah.

"EC is waiting for the official postal ballot result," he says. Meanwhile, EC deputy chief Wan Ahmad Wan Omar says the commission will explain the delay soon.
"I'll explain after we announce the result shortly," he tells Malaysiakini.

10.09pm: All top DAP leaders are waiting at Wisma Sanyan, where the postal ballots were counted.Lim Guan Eng tells Malaysiakini that he is worried “something suspicious could be going on” and he hopes that the Election Commission officials can release the Form 15, a document which certifies the final result of the postal ballots.

Should it be true that BN has won the postal votes by a margin of 2,300, then DAP will be declared the winner of the Sibu by-election with a tissue-thin majority of 300 votes. It is confirmed that Deputy Prime Minister Muhyiddin has returned to Kuala Lumpur.

There is no movement at the main tally centre in Dewan Suarah in Sibu. The official tally still indicates that 16 boxes, including the postal votes, are yet to be sent to be included in the final result.

9.50pm: DAP supremo Lim Kit Siang questions the hold-up in the Election Commission's announcement of the 2,571 postal ballots.

"The postal ballot counting started at 5.30pm and finished at 8.30pm."
He asks why there is more than an hour delay in the announcement of results.
"Up to some trick?" he wonders aloud.

9.35pm: The counting of postal votes has ended. However, DAP scrutineers are unable to get Form 15 - the official tally signed by the returning officer.

It is understood that BN has won 2,300 out of a total 2,571 postal votes. This will translate into a DAP victory with a margin of 300 votes.

DAP candidate Wong Ho Leng refuses to claim victory as yet."I don't want comment. Please wait for the official announcement," he told Malaysiakini.

9.24pm: The final result may not be announced anytime soon. The 2,571 postal votes are still being counted. All DAP leaders leave the party's operations room in Sibu for Wisma Sanyan where the postal votes are being tallied.

DAP supremo Lim Kit Siang wants to know what is holding up the Election Commission from announcing the by-election result.

9.21pm: Election Commission chief Abdul Aziz Yusof sends a SMS message to Malaysiakini saying that the voter turnout "could be more than 60 percent".
Malaysiakini has earlier asked him to confirm whether the voter turnout was 59.86% as announced by the EC a few hours ago.

9.10pm: Penang Chief Minister and DAP secretary-general Lim Guan Eng and other party leaders are set to leave the party's operations room in Sibu.

But instead of going to main tally centre at Dewan Suarah, they plan to go to Wisma Sanyan, where the postal votes are being counted.

8.57pm: According to the latest unofficial tally, BN has reduced DAP's lead down to 2,590 votes. A total of 109 out of 110 polling streams have been counted thus far.

DAP - 18,570
BN - 15,980
Ind - 201
Majority - 2,590

7.40pm: According to the latest unofficial tally, DAP's lead breaks the 3,000 mark for the first time - it is now 3,022 votes. About 90.5% of votes have been counted so far.
DAP - 16,178BN - 13,156Ind - 135Majority - 3,022

7.30pm: According to the latest unofficial tally, DAP has again increased its lead to 2,817 votes. About 87% of votes have been counted so far.

DAP - 15,655
BN - 12,838
Ind - 132

Majority - 2,817

The 2,571 postal votes are now being counted!

In the 2008 general elections, SUPP won 94% of this postal votes.

Several glaring postal voting discrepancies detected yesterday at the Sibu by-election has again raised questions about the credibility of the postal voting process.

DAP Youth chief Anthony Loke (centre in photo) today demanded explanations from the Election Commission (EC) on three separate issues detected by party polling agents at various postal voting centres.

At 5.45pm, DAP candidate Wong Ho Leng was at the Sibu EC office to post his objections over the postal voting process.

This was followed by a huge row between Wong, BN candidate Robert Lau and EC deputy chief Wan Ahmad Wan Omar over the matter.

Loke said the most serious discrepancy was that several codes (police or army personnel voter-groupings) saw returned ballots in excess of the number that were issued on May 12.

He identified Code 708 (police) where six ballots were distributed, and 24 returned. Code 429 (army) saw 160 ballots issued and 161 returned. For Code 43 (army), 47 were issued and 67 returned.

“For the postal voting process to be legitimate, even a single vote cannot be exceeded. In this case, we are talking about a 39-vote difference,” said Loke, who is Rasah MP.

Taking ballots home The second discrepancy, noted Loke, involved the 290 ballots that were issued to EC workers who applied to be postal voters because they were working on polling day.

Loke said that about 200 of such voters did not vote on the same day (May 12) and went home with their ballots, which he argued could then be “sold”.

“If taken out of the polling centres, ballots becomes a commodity to be sold. Now, no one will know who actually marked those ballots that were issued,” he said.

Loke added that there were also dubious individuals among the 200-odd voters who returned their ballots yesterday, some of whom refused to be identified by party scrutineers.“One person looked more like a VCD seller than an EC worker (left).

He had some young people with him. Our people tried to check their ICs but they all claim that they forgot to carry it with them,” he said.

Reforms overdueThe third discrepancy detected by DAP was that out of the 290 postal voters who were EC workers, two were not even in the electoral roll.

“When we demanded for their IC, they promptly left,” he said.Loke said the DAP decided to highlight these issues to show that there is a need for a total reform of the postal voting process, which is a long standing issue because the process is riddled with flaws and open to abuse and manipulation.

“But for now, we demand a thorough explanation from the EC,” he said.He also questioned why the EC permitted voters to bring their ballots home for several days instead of marking and casting them on the spot.

1 reason why Christian should not back the BN Govt in the Sibu election!

BN Govt is like a snake that offers a flower to you but has a dagger behind them ready to stab you in the back!

While they talk about being more able to bring development and economic prosperity compare to the opposition, they may not have the political will to actually do it in the long run.

Especially after the by-election!

When was the last time the PM comes to Sibu to give 18million to the schools there??

When will the do it again? Actually they should be doing more in terms of development for the area. After all they are the state and federal govt with all the resources. It is their duty!

The people in Sibu shouldn't have to wait for their MP to die before they can hope for money from the federal and state govt!
That should not be the way!
THAT IS WRONG!

Whatever it is, some things money just cannot buy!

I hope the people in Sibu will feel that way as well! I hope they should also demand for religious freedom, freedom of speech, equality, justice and for the future of their children,

Just read this article!
I hope the Christian will consider carefully how much their faith is worth when they vote in this by-election!!

MIC arrogance against their own race!

'No effect'.

Those were the words of BN's Hulu Selangor by-election candidate P Kamalanathan when asked for his opinion on whether the well-known Indian rights movement would be able exert its influence among the constituency's Indian electorate.

"Hindraf? No effect. The people will judge us from our work not by any individual. Most of them have forgotten (Hindraf)," he said, dismissing the movement in having any impact in the upcoming by-election.

Kamalanathan said there were still some who were keeping the legacy of Hindraf alive "...but the Hindraf by-products themselves are not sure where they are heading".

I hope all the Indians (and their friends and family) who got whack at the Hindraf demonstration in the past will wake up and help campaign against P. Kamalanathan for his arrogance against his own race!

Is our CJ a lame duck? Or is this Ex-Judge right about our current judiciary's stupidity?

Read this article from Malaysian Today!
All Malaysian should read this!

In his latest scathing critique, he said the rakyat is “stunned by the ignorance of our judges of the highest court in the land”, as seen in the recent Federal Court’s decision not to review Anwar Ibrahim’s application to review its previous decision dismissing his application for disclosure of documents for his second sodomy trial.

By Martin Jalleh

The integrity of the judiciary has been badly mauled by a legal lion who does not mince his words no matter how high or mighty a judge thinks he is.

He has called a spade a spade and certain members of the judiciary an “incompetent” and even an “idiotic” bunch!

All the Chief Justice (CJ) and the judges in the Palace of Justice have managed to do is remain mum, mute and mumble amongst themselves as N H Chan methodically makes them out for who they really are and the mockery they have made of the law!

The respected, renowned and retired Justice N H Chan is very frustrated, fed-up and furious at how the judiciary which he had served so faithfully has been reduced to a farce run by those who are legal and intellectual frauds or what he has called “imposters”!

With each passing compromised judgment N H Chan unhesitatingly hits out at judges with an increasingly sharper sting.

He leaves no stone unturned, no errant judge uncovered. They can “no longer mask their hyperbole judgments with unintelligible garbage”.

“Fools on the bench”
In his latest scathing critique, he said the rakyat is “stunned by the ignorance of our judges of the highest court in the land”, as seen in the recent Federal Court’s decision not to review Anwar Ibrahim’s application to review its previous decision dismissing his application for disclosure of documents for his second sodomy trial.

N H Chan said the Federal Court’s approach to Rule 137 of the Rules of the Federal Court 1995 was “inconsistent” and “dishonest” and “those ignoramuses” were talking “utter nonsense”.

Those “inane judges cannot even understand plain English”! He put it very plainly and painfully!

Calling the three-member panel of Justice Zulkefli Ahmad Makinuddin, Mohd Ghazali Mohd Yusoff and Heliliah Mohd Yusof “incompetent”, he added “perhaps they were clowns as their statements were laughable”.

His searing criticism was that they “…do not know justice from injustice”, and that “such lowly individuals should never be allowed to sit on the seat of Justice…(and) to be judges at all.

And yet there are so many of them in the judiciary today ever since the rot begun.”

He shredded into smithereens the “judicial renaissance” of the CJ:
“Our country does not need impostors, who pose as judges, to deceive the common people any longer. The common citizenry can now uncover the impostors hiding beneath the mantle of the judicature.”

He laid bare the judicial sham: “With judges such as these in the Malaysian judiciary where, to them, the principles of the law are not to be consonant with justice to be manipulated by them to uphold injustice, it is no wonder that the errant judges have forfeited the confidence of the people. ”

He left them with a stinging slap in the face: “The general public does not respect such judges anymore! They have put themselves beyond the pale. Just like pariahs. Don’t you think they should be despised?”

On High Court judge Justice Mohamad Zabidin Mohd Diah’s rejection of Anwar’s application to have the judge recuse himself from further hearing the sodomy trial, N H Chan said that the judge was talking “utter nonsense” and “knew next to nothing about judicial bias”.

He added that the “moral of this unsavoury episode” is this: if you appoint mediocre lawyers to the Bench you will get substandard judges. The solution to this problem is a simple one. Appoint judges from the cream of the legal profession and you will not find me assailing the judges for incompetence simply because I will not be able to do so.”

Such was his cutting conclusion: “It is only when we have fools on the bench that I can point out that what they have decided is not the law.”

“Bunch of idiots in high places”
N H Chan had not spared the judges in the cases related to the Perak constitutional crisis of his very strong language when scrutinising their decisions (with the exception of Kuala Lumpur High Court Justice Abdul Aziz Abdul Rahim whom he had praised).

He highlighted the “bad” and “perverse” judgments, especially those in the appellate courts, the collective written judgements which were “riddled with contradictions” and how the Perak and Federal Constitutions were toyed with and trampled on by the judges!

During the Perak debacle N H Chan had said that there are “many of our judges today especially among those judges in the higher echelon of the judicial hierarchy who do not seem to know the true meaning of separation of powers in constitutional law. This is most apparent.”

He called some of the judges of the cases of the Perak imbroglio:
a) Bad judges – they “seem to think that independence means that they can do what they like”
b) Recalcitrant judges – “they think that words can mean whatever they want them to mean”
c) Humpty Dumpty judges – “they also think that they are independent of the legislature”.

N H Chan has brought to light how beholden the judiciary is to the Umno-dominated

Government. He said the “so-called Perak crisis has brought out a host of cases that showed that the judges gave the impression that they were one-sided. The perception of the people is that they sided with the BN government.”

In the “shocking case” of Zambry v Sivakumar in the Federal Court, he called the judgment by the “infamous five” (judges) Alauddin Mohd Sheriff , Arifin Zakaria, Nik Hashim Ab Rahman, Augustine Paul and Ahmad Makinnuddin, a “perverse decision”.

In the case of Nizar vs Zambry he called the panel of five Federal Court judges made up of the President of the Court of Appeal Alauddin Mohd Sheriff, Chief Judge of Malaya Arifin Zakaria, Zulkefli Ahmad Makinuddin, Ghazali Mohd Yusoff and Abdul Hamid Embong, “myopic judges”.
They “were lost in a quagmire of confused thinking caused by their own incompetence. They found themselves deep in the forest unable to see the wood for the trees. Does this mean that we have a bunch of incompetent judges who sit in the highest court in the land?”

Alas, with the help of N H Chan the public especially those in Perak were able to see for themselves how members of the judiciary had left behind a dead constitution, “bad” and “perverse” decisions, dubious declaratory orders, judgments devoid of reasoned grounds, and disgraceful double standards.

Blind and Biased Judges
N H Chan has “judged the judges”. He considers them, especially those in the appellate courts’ “ignorant”, “inane”, “incompetent” and even “idiots” (which he has strongly inferred).
The public shares his view. In their eyes the judiciary has allowed itself to be intimidated, its independence and impartiality interfered with, and its integrity reduced to ignominy.
In the light of the severe criticism of N H Chan of the judiciary (which is quite unprecedented by a retired judge), surely the Chief Justice cannot stand idly, silently and stoically by – unless Zaki Azmi strenuously, staunchly and solemnly agrees with him!
Further if Zaki continues to remain silent the public will assume that he shares N H Chan's searing criticism of the judiciary. Logically he would have to resign for he has allowed the reputation of the judiciary to be sullied irreparably.

The judicial shenanigans whom N H Chan has criticized and castigated should also resign for having shamelessly sacrificed justice on the altar of political expediency.
N H Chan’s comments on members of the judiciary have no doubt been bold, blunt and blistering. He has accused judges of being blind, biased and being a bunch of “idiots” and “fools”.

He has thrown the gauntlet down.
If the CJ disagrees with N H Chan’s criticisms he should haul the former Court of Appeal judge into court and demand that the latter shows cause for why he should not be cited for contempt! Does Zaki have the guts to take up the gauntlet or will he prefer to allow the judicial circus to go on?

N H Chan has made no bones about it. His blitzkrieg on the judiciary will continue. “Bad guys” had better beware! He will ensure that their names remain in infamy for generations to come unless they recant the wrongs that they have done! He will even write their obituary and if they outlive him there will be others who will take his place!

N H Chan sees the next general elections as the only solution to an unsalvageable judiciary viewed by the public with greater suspicion, skepticism and even scorn. He once commented: “At the present time and judging by what we have experienced so far from the Perak takeover cases, the quality of most of our judges is suspect”.

“In the meantime what should we do with so many bad apples in the barrel? If only there could be a change in government in the next general elections with the opposition winning by a landslide. Then we could get rid of all the bad apples by Act of Parliament.”

SCREW ability, integrity or capability! As long as we win!!

Who cares if the guy is an old man!
Who cares if he is tainted with corruption!
Who cares if he has the caliber or the energy to serve the people in the area!

As long as he is popular and can guarantee a win!!
Earlier the SUN reported that...
Muhyiddin said they had gone on the ground to assess the people's feeling on the BN candidate and "it looks like they wanted Isa".

He said Isa's candidacy was decided based on popular demand, and he believed that it was the right decision.

Hishammuddin also called Isa the “people’s candidate,” in an acknowledgement to polls which suggest the former Umno vice-president was very popular in Bagan Pinang despite being tainted by his corrupt past.

Is UMNO treating this by-election as a popularity contest ah?
If I am hearing this correctly from our DPM... UMNO chooses its candidates base on their popularity and not on the quality of the candidate, or how clean, worthy, integrity or the candidate's ability?!?

Wah like that I also can lah! Just bribe the majority group in the area with contracts and other goodies and become popular with them lah!

Opps! Isn't that what got Isa sack from UMNO in the first place?!?

Don't be surprise if this becomes his by-election campaign tactics! (i.e. bribe the voters there with the promise of goodies and development!)

The votes in Bagan Pinang should ask the question...

Why does it take the death of their former state rep before UMNO will come in to help them? What about before this by-election? How much attention did UMNO gave to them?

Also the voters in BP should ask if Isa is really the "people's choice" or is he "UMNO's people choice"! Would they really benefit from his election or will he only look out for his UMNO's gang!

Umno leaders will argue that Isa has already paid the price for being found guilty of greasing the palms of party delegates in the Umno elections five years ago. They will note that he has suffered enough as a political leper and point out that he took his punishment without much protest.

Others may even put a different spin on the second coming of Isa by saying that it shows what a forgiving political party Umno is.

BUT THE QUESTION IS, HAS DATUK ISA SAMAD TRUELY REPENTED OF HIS SINS?

What he said in the Sun newspaper may shead some light on this matter.

When told of the likely scenario of the opposition having a field day bringing up his tainted past, Isa said: "I did not commit a crime. I'm not a criminal. I just did not follow party election ethics and I was punished for that."

Just did not follow party election ethics?!?

The man calls coruption, "not following party election ethics!"

I really hope the people in Bagan Pinang are not as dumb as he is!!

The End of B End! - Isa! BN's Candidate for Bagan Pinang

For the 2nd time in a row, UMNO chooses a candidate tainted with corruption.
At Permatang Pasir by-election, they chose Rohaizat Othman a disbarred lawyer (for misusing clients’ funds).

One would think that it would be difficult to find someone more unworthy than a disbarred lawyer, but trust those UMNO folks, to scrounge even lower to find someone even worse than that.
Now for the Bagan Pinang by-election, they choose Tan Sri Isa Mohd Samad who was suspended by UMNO’s very own disciplinary board for money politics

In Isa Samad UMNO has someone who had been expelled from the party for “money politics,” the euphemism for corruption. Knowing UMNO’s shady ethics, to be expelled for that must take some doing.

And the most amazing thing is that UMNO’s members from that branch wanted only Isa and even threatened to boycott the by-election if UMNO chose another candidate. The fact the Bagan Pinang’s UMNO branch demanded for Isa’s selection only reflects the kind of people who are members there.

An online news splash the news of banners that was placed at several places where UMNO members claims that they will boycott the election if Isa was not chosen. Despite the denial of UMNO Teluk Kemang in putting up the banner, it is quite clear that it was put up at the 11th hour after Muhyuddin said that there is another candidate that UMNO Teluk Kemang had overlooked. It is obvious that the banner was put up in a timely manner to pressurized UMNO national leadership.

It is indeed sad that the members has chosen to proposed and demand a particular candidate instead of demanding that only the truly clean and trustworthy candidate will contest. Indirectly UMNO Teluk Kemang support corruption. Who knows maybe they had benefitted in some way or other previously and expected the same after the election?

But having tasted so many defeats, Najib will do almost anything to win one by-election in Peninsular Malaysia. This include picking a man tainted with corruption and has nothing more to offer the state after being in power (as Mentri Besar) for over 24 years. If he had any talent or innovative ideas, that should have been obvious during all those years.

At this stage of his careers, he should be seeking out and mentoring the next generation of leaders, not desperately hogging the stage.
Only last week Muhyiddin was at pains to point out that he was intent on seeking fresh talent, especially after the Bagan Pinang branch folks brazenly declared that Isa was their only choice.

But Najib must be so desperate to win a by-election, that he bowed to pressure and chose a tainted man like Isa.

This selection of Isa is the consequence of many years of handouts in which UMNO gives out contracts to their members. And Isa is popular not because he is a quality intelligent leader, but a leader who knows how to manipulate the system to pass contracts to the relevant people.

All the noise from Najib that he wants transparency and accountability in his government is mere empty words and promises. By right, UMNO should discipline their members at Bagan Pinang for even threatening to boycott the election, but instead he chose the easy path for short-term gain.

The earlier rhetoric about UMNO having “to change or be changed” is now proven to be nothing more than just “cock talk,” to put it in the local vernacular. In picking Isa, it is clear that UMNO does not have the will to change and has abandon their commitment to reform itself.

It is very unlikely that Pakatan will win this seat as it is traditionally an UMNO seat. So, I can imagine that Najib craves the right to brag after UMNO wins (assuming they do), to the entire Malaysia. After all, history has shown how UMNO brags that the people support them, and how the opposition is rejected at every by-election they won.

UMNO is the cancer of this country, Malaysians must open their eyes to see that they cannot go on being governed by people who subscribe to corruption as a normal practice!!

As predicted, UMNO confirm that they will contest in Manek Urai!

As I have said earlier, UMNO will contest in a by-election if they believe they have a chance to win! NTV7 today reported that Najib and Muhyiddin Yassin confirm that UMNO will contest in the Manek Urai by-election.

What happen to saving the rakyat's money and the other stupid reason BN gave last week on not contesting in the penanti by-election?!?!

I hope the people in Manek Urai will waste BN money and keep PAS with them!

A Final Note for Today:
BN may have won Perak and the Court of Appeal judgement but they definitely have lost Malaysia and the People's Court!

Another Great Article from NH CHAN!

NH CHAN is a former Court of Appeal judge.

His latest article on...
Why isn’t there a written Federal Court judgment on the Perak debacle?

The answer can be simply put.
It is because Article 72(1) of the federal constitution is written in unambiguous language which even a child can understand.

If you don't have access to Malaysiakini to read it, I have cut and past it here for all to read!
Very simple and easy to read!

Najib say dun wanna waste public funds! But here is a list that shows how much public funds already been wasted by BN!

The reason why Najib says the by-election will waste public funds is because they spell by-election as "BUY-election".

But today in Malaysiakini there is an article on how much public funds has been wasted by BN already due to corruption!!
Below is just a section from the article!

Catalogue of corruption
Some idea of the staggering amount can be gleaned from an excellent article that one of my contacts sent me from MalaysiaToday.

Written by ‘ez42get’, it reminds me that in the March 15, 2004 issue of Time Asia magazine, Daniel Lan, the Southeast Asian economist with Morgan Stanley in Singapore, was quoted as estimating that Malaysia "may have lost US$100 billion (RM320 billion) since the early 1980s to corruption".

The article also contains a long, long catalogue of crimes and incompetency, although these are just "the tip of the iceberg" according to its author.

They include:
The Bank Bumiputra scandals of the early 1980s
(Cost, RM3.2 billion)
Maminco’s 1980s attempt to corner the global tin market
(RM1.6 billion)
Bank Negara losses on foreign exchange futures in the 1990s
(RM30 billion)
Perwaja Steel losses
(RM2.56 billion)
Bank Islam scandal
(RM700 million)
Wang Ehsan from Terengganu oil royalty
(RM7.4 billion)
Shoring-up of Valuecap Sdn Bhd with public funds
(RM10 billion)
Commissions to Perimeker Sdn Bhd and IMT Defence Sdn Bhd on fighter and submarine deals
(RM910 million)
Non-itemised IT equipment purchased for schools
(RM2.21 billion)
Soft loan to PKFZ
(RM4.63 billion)
Customs, Immigration and Quarantine complex for cancelled crooked bridge to Singapore
(RM1.3 billion)
Compensation to Gerbang Perdana for cancellation of crooked bridge contract
(RM300 million)
Two bailouts of Malaysian Airlines System
(RM7.9 billion)
Bailout of Putra LRT system
(RM4.5 billion)
Bailout of STAR-LRT system
(RM3.256 billion)
Bailout of Kajian Makanan dan Gunaan Orang Islam
(RM8.3 billion)
Compensation paid to 20 highway companies, as announced in 2006
(RM38.5 billion)

I make that about RM126 billion so far, or, according to my possibly somewhat suspect arithmetic, around $4,680 for every man, woman and child in Malaysia.
But we’ve barely even started yet.

BN Creates History and Chickens Out of Penanti! What will happen next!

Najib and gang are really scare to loose this days!
BN is refusing to face the Rakyat at all cost!
I have never seen a situation like this in Malaysia before! Wow!

For all the BullS**T reasons they give, we all know the truth!
And the truth is that if they thought they had a chance to win in Penanti they would have stood for the election! Then all the stupid reasons they gave would have disappear!!

The fact is that BN themselves don't believe that they can win! In fact, they are afraid to score more OWN GOALS if they decide to campaign there!

But do you think they are going to sit still and do nothing?!?
Like all sore losers I am sure BN will play their role of spoiler!

I am sure they are gonna back some independent candidate and campaign for him indirectly!
With no candidate in place for the Penanti election this time, BN will have to change their strategy and go on an indirect campaign trail to smear PRK instead of promoting their own candidate...
OPPS! Actually that is their usual strategy with or without a candidate!!

The interesting will be to see if the Election Commission, the Police and other enforcement officers allows BN from holding ceramah and etc during the campaign trail!!

I would like to go to Penanti to see the town during the campaign trail. It would be interesting to see only PKR banners and poster and no BN posters at all!! Wow! What a sight to see!!!
But somehow I have a funny feeling that will not happen!

Stupid excuse made my stupid BN leaders after their defeat!

I was reading Malaysiakini on the BN leaders reaction to their losses in the two Bukit seats!

Some of the VVIP excuse for their losses really make them look stupid!!

Example 1
New Umno deputy president Muhyiddin Yassin
Insisted that the by-elections are not a referendum of Najib Abdul Razak's premiership as he has just taken over the office. "Maybe the people have a feel-good factor relating to Najib's premiership, but they have yet to absorb the good feelings."
(HAHAHAHAHAHA!!!! Absorb the good feelings?!?! WTF is he talking about?!?!?Hahahaha!!)

Example 2
MCA President Ong Tee Keat
"They (the rakyat) do not want to hear promises of change but they want to experience real change," he said on his blog."
(Now only you realize this ah?!?!Slow lah you!!)

Example 3
Newly-minted Umno vice-president Hishamuddin Hussein
"We must see what needs to be changed...... We must study the trend of the voters and see what else needs to be satisfied. "
(Huh! Until now you still do not get what the rakyat want ah?!?! Is he retarded?!?!? So simple!! First...don't bully the Indian community! Second!! Dissolve the Perak state govt!!! Third! Don't cover up the truth behind the Altantuya murder!!! Like that also cannot understand ah?!?!?)

He also said....
"You must understand, this is not our seat and not our state, we did not lose our own seat. So to look at it in such a defeated manner... I am not prepared to do that,"
(See this the perfect example of BN leaders who cannot get to grip with reality!! Face it! UMNO is sinking!! That seat was MIC for so long until 8th March 2008! And soon the whole country will also not be your seat anymore (weather you can accept it or not!!!)

BN 1 PKR 2 - Congratulation Rakyat Malaysia!

Today the people of Malaysia shows just what they think off their new Prime Minister and his advisor (Tun Mahathir)!!

I believe the people of Perak also just told the Sultan of Perak just what they thought of his decision with regards to the Perak government!

Bukit Gantang
OFFICIAL RESULTS
Mohd Jamaluddin Nizar (PAS) 21,860
Ismail Saffian (BN-Umno) 19,071
Kamarul Ramizu Idris (Ind) 62

Majority - 2,789 (In 2008, the majority was 1,566)

Batang Ai
OFFICIAL RESULTS
BN's Malcolm Mussem Lamoh (3,907 votes)
PKR's Jawah Gerang (2,053).

Majority - 1,854 (In 2006, the majority was 806)

Bukit Selembau
Manikumar retained the seat for PKR by winning with a 2,396-vote majority
(In 2008, the majority was 2,362-vote majority)

Pity the Batang Ai people still do not have the resolve to change for the better! I guess you can say they are still in the dark. Probably because the BN government still have not provide them electricity (even through there is a hydro dam next to them!)

Najib release 13 ISA detainee! SO WHAT!

SO Najib release 13 ISA detainee.
Big deal!
We all know it is just a publicity stunt!
In fact, this only proves that the BN govt catches and release its own citizens at their own conveniences, and for their own selfish reasons!!!

Where is the rule of law, the human rights law, the basic human decency?!?

If Najib was serious about reforms , he would have release all the detainees, close down Kamunting camp and abolish the ISA completely!!!
Follow Obama's example lah!! See he had the guts to close Guantanomo Bay camp!

DO YOU KNOW....

Some of the ISA detainees that were freed were pose certain condition to their release?!?!?

For example, the two Hindraf leaders are not allowed to leave Shah Alam and Petaling Jaya, and must be home by 7 pm every night, exchanging detention in Kamunting Detention Centre!!

THIS IS NOT REPORTED IN THE NEWS RIGHT!!?!?!

Hah!! So much for ISA detainees being release!
Najib promised to conduct a comprehensive review on the ISA.
Are we not sick of that stupid reason BN govt always give by now!?!?!
Always say we will study the matter but no action wan!!!

Personal Attack! BN style of Campaigning

When you campaign in an election, you talk about National Issues, Local Issues, how to help the community.

It is only when you are desperate, that you resort to dirty tactics by smugging your opponent's good name!

This is what BN has resort to!
Shameful, dirty, corrupt BN tactics!!

I can understand if you attack a candidate if you can prove that he is corrupt and has a criminal record. However to attack them on personal issue is just plain desperate!!

What's more to attack Elizabeth Wong who is not even a candidate in the by-election shows just how low BN has sunk!!

How dare BN talk about other people's morality when they have sexy girls dancing for them in their ceramah just before their VIP speaks?!?!

Why are the BN component parties women's wing not come out to protest this type of dirty tactics?!?!?

Is it because they are useless, toothless and under the complete control of their UMNO slave masters?!?

I hope people in the by-election area are mature enough to see through BN's childish, shameless, dirty tactics and kick them completely out of their area!!
