Inspector-General of Police Ismail Omar has clarified that confiscating memory cards and cameras belonging to journalists is not part of the police standard operating procedure (SOP).
This contradicts Home Minister Hishammuddin Hussein’s claim that the seizure of journalists’ equipment while covering Saturday’s Bersih 3.0 rally was part of police SOP.

"There is no such thing. We act in accordance with the law," Ismail replied curtly when pressed on the matter at a press conference at the police headquarters at Bukit Aman.

Yesterday, Home Minister Hishammuddin Hussein said that the camera and memory cards belonging to journalists were seized as part of the SOP.

Zan figured something was amiss by early evening when he noticed that many police officers had taken off their name tags. And then he saw gangs of them beating up protestors.

He talks about how journalists got assaulted for shooting pictures and videos of police brutality. He himself was manhandled, hauled in and briefly detained by the police.

After he was released, as he walking towards his car, Zan noticed a number of people lying unconscious on the street as ambulances came to pick them up one by one.

Satellite TV network Astro has admitted to censoring the BBC news report on the Bersih 3.0 rally it aired last Saturday "to comply with the national content regulations".

In a statement emailed to Malaysiakini from Al Jazeera English's head office in Doha, Qatar, the network said Astro has to date not informed them about the possible cuts made to its news programmes.

"Our news report was a factual account of events that day, and intrusion in our editorial process is unwarranted. We have not been censored in this way by another distribution platform anywhere in the world," it said




5. Traffic Police officer pulling his gun on civilians! 


An eyewitness has come forward to reveal that a traffic police officer had pulled out his gun and aimed it at a protester during Bersih 3.0 last Saturday.

According to KL Lai, the police officer pointed his gun at a protester at Jalan Esfahan after another officer crashed his patrol car into protesters.

“I saw a protester freeze and put his hands up. The traffic police officer had his back on me.

What is the reason for Bersih 3.0? Kim Quek explains clearly!

COMMENT It is now confirmed - the parliamentary select committee (PSC) on electoral reform report is a scam to hoodwink Malaysians into thinking that the Barisan Nasional (BN) government is finally restoring democratic election.

While nothing concrete has been achieved to ensure the cleansing of the "phantom" infested electoral roll and the elimination of rampant corruption and abuse of power that has become the trademark of Malaysian elections, the main stream media has painted the town red with false propaganda that the PSC report is a reform agenda that will make any democracy proud.

Just look at The Starnewspaper of April 4. The entire front page was splashed with goodies from the PSC, headlined ‘Hooray for voters’.

Some of the prominently displayed items were: ‘Allowing citizens to vote by post or at Malaysian missions’, ‘Creating a caretaker government after the dissolution’, ‘Continuous cleaning of the electoral roll’, ‘EC to have its own budget and be answerable to Parliament’, ‘EC to be restructured to enforce election laws’, ‘Provide allocations to political parties and candidates based on the number of seats and number of votes obtained’, and ‘Have a balanced delineation election constituencies’.

Wah! Isn’t it wonderful. From now on, Malaysians can finally raise their heads to claim that they have a practicing democracy!

But, rejoice not. This PSC report is not a bearer of fruits but a messenger of false hopes.

The PSC report’s 22 recommendations are only a series of expressions of hope that the Election Commission (EC) will do this or that.

Knowing the deeply political partisanship of EC and its unashamedly pro-BN stance to resist reform, what hope is there anything meaningful will be done to alleviate the nightmare of Malaysians of another dirty election ahead - by all counts, the worst?

There was not a word in the report on the numerous cases of fraud uncovered in the electoral roll or on the blatant open bribery and abuse of power that have gone from bad to worse from one by-election to another since the 2008 general election.

Hypocritical participation

Without acknowledging and probing the existing flaws how can there be any remedy?

There was no concrete measure proposed or firm commitment made by any quarter in the BN regime that the serious flaws that have made a mockery of our election will be rectified before the next election.

In fact, the hypocritical participation of EC in the PSC reform effort is glaringly demonstrated through the continuing cheating in the electoral roll that was going on out right during the working sessions of the PSC.

This was exposed during the press conference of Bersih 2.0 announcing its impending mass demonstration on April 28.

At the press conference on April 4, two academicians with authoritative research on Malaysian elections revealed numerous cases of ongoing fraud in the electoral roll.

Wong Chin Huat (left) demonstrated four methods adopted by fraudsters to “clone” voters through variation of one or more of personal data like names, old and new identity card numbers, addresses and dates of birth.

Ong Kian Ming revealed irregularities in the postal voter roll that showed double registration and unqualified postal voters among the security personnel. These instances were described as only the “tip of the iceberg”.

From numerous previous revelations, it is now an established fact that our electoral roll is heavily infested with “phantom voters” - either through manipulation of the electoral roll or through illegal granting of citizenship to foreigners (which is particularly rampant in Sabah as proven in court).

It is therefore imperative and of utmost urgency that an independent body be commissioned to comprehensively audit both the electoral roll and the citizenship registry to flush out these “phantoms”.

But there was nothing in the PSC report to even remotely suggest that this cleansing process will proceed forthwith.

It is ironical that the PSC which is dominated by BN, instead of scrapping the notorious postal voting system as strongly demanded by reformists, has further expanded its scope.

This postal voting is a discredited system that has been profusely abused to give consistently more than 90 percent electoral support to the ruling BN.

Illegitimate advantage

Originally meant for the soldiers and police, it will now be extended to cover media workers and EC personnel, the latter, according to reports, has alarmingly increased from 140,000 to 240,000 personnel.

This decision by PSC which quickly acted upon by EC to gazette the new postal voters will no doubt add a major illegitimate advantage to BN in the coming polls.

Another major injustice that has rendered our election meaningless is BN’s stranglehold on the mass media (save the Internet), which while serving BN’s parochial political interests in ordinary times, is turned into full blast propaganda machines in election time to falsely glorify BN while running down or blacking out news of its opponents.

Electoral democracy being a game of perception, the existence of such a grotesquely lop-sided information dissemination system makes a total mockery of our democracy, not to mention putting BN’s opponents in grave disadvantage.

In recognition of reformists’ earnest requests for free and fair media coverage, PSC has, however, only given its lip service.

In recommendation No.9, PSC merely says it has “taken note” of the Information Ministry’s “readiness” to grant fair media access to all parties and candidates in the poll.

PSC further “recommends” that the EC take note of Article 115(2) of the federal constitution which stipulates that other authorities shall on request assist EC to discharge its duties as may be practicable.

If fair reporting is a serious undertaking by BN, why didn’t the ministry give a solemn pledge to honour this “readiness” instead of only the EC “taking note”?

Will this “note” taken by the EC lead to fair media coverage? Knowing the disposition of EC and BN, your guess is as good as mine.

It should be apparent by now that no real reform will come while BN is in power, for any reform - particularly electoral reform - would mean the reduction of the illegitimate advantage enjoyed by them in the contest of political power.

And the present fake reform as exemplified by the setting up of this PSC was only a grudging concession thought of by Prime Minister Najib Abdul Razak to recover some of the electoral support lost during the ill-advised crackdown on the Bersih 2.0 rally on July 9, 2011.

From that point of view, Bersih 2.0’s prompt call for another mass rally is a wise move. For only in the convincing show of strength could BN see the necessity to make some reforms, however disinclined it may feel towards them.

A simple explanation on why Malaysia's Elections are unfair

All Malaysian should read this article from Malaysiakini to understand why BERSIH 3.0 is crucial if the government does not reform the electoral process!

A retiree arrested the attention of opposition members at the public hearing by the parliamentary select committee (PSC) on electoral reform, when he told them to forget about marching to Putrajaya under the current electoral system.

Armed with printouts of his presentation slides, Ng Chak Ngoon (right) who described himself as a retiree, presented the panel with a graph that showed 222 lines with every one being taller than the other as it progressed.

The graph, said Ng at the hearing in Kota Kinabalu yesterday, which saw several others testifying, was plotted against the population size of all the constituencies in ascending order for the 2008 general election.

"All on the left (in blue) are won by BN, on the right (in red) are all won by the opposition. The BN constituencies are very small and the opposition constituencies are very big. So what is happening here?

"It's not by chance that all the people in big constituencies like the opposition and all those people in the small constituencies like BN. I would think there is a design here for the Election Commission (EC) to sub-divide all the BN areas into smaller areas to increase their number of MPs," he said.

Ng added that the smallest constituency, BN-held Putrajaya only had 6,008 voters but Opposition-held Kapar had a staggering 112,224 voters, 17 times more than Putrajaya.

‘Kapar can have 17 MPs'

"If we break down Kapar to the size of Putrajaya, you would have 17 MPs from Kapar instead of just one."

If all the seats are made into equal size, Ng added, the last general election would yield a result where BN and Pakatan Rakyat would only have a difference of seven seats in Parliament as opposed to the actual results of 140 to 82 seats.

He further estimated that if a party relied on all the small seats to win power, it would only require 15.4 percent of the total votes to form a majority in Parliament.

"If the opposition thinks they can march to Putrajaya, forget about it."

At this point, PSC member Anthony Loke who is DAP's Rasah MP quipped: "Very demoralising."

Explaining further, Ng said the smallest constituency in Malaysia was 13 percent of the national average while the largest was 288 percent, in contrast to the UK's which smallest and largest constituency are 77 percent and 153 percent of the national average respectively.

"If the EC is sincere, it should redraw all the constituencies, this is not gerrymandering, this is outright cheating."

PSC member Dr Hatta Ramli later concurred, pointing out that the Baling parliamentary constituency, supposedly a rural seat, had an unusually large number of constituents at around 70,000.

"This was because PAS has won the seat before," said Hatta, who then asked if Ng thought this was ethical.

"Unethical is a mild word, Can I answer outside?" replied Ng in reference to parliamentary rules that require members in the hearing to abide by appropriate language.

State by state breakdown

Ng later proceeded to present similar graphs with a state by state breakdown at which PSC member Mohd Radzi Sheikh Ahmad said: "Can you rate Kangar?", in reference to his own constituency.

"If you have Negeri Sembilan's, I would like to see my chances of winning," added Loke.

At this, Ng quipped: "I'll have to charge you for consultancy."

When asked by PSC member Fong Chan Onn (right) on how the panel can accommodate the increase of seats for Sabah and Sarawak to meet the Malaysian Federation agreement of 34 percent into his recommendations, Eng replied: "What is your objective?

"To win the election or to have an equitable dispersion of votes? If these are conflicting desires, obviously we cannot come to a compromise. BN has to answer that question, not me, I'm a retired man."

The right reaction to stupid MCA proposal!

The Coalition for Clean and Fair Elections (Bersih 2.0) today (12 Nov) took a strong stance against MCA's proposal to disallow voting for Malaysians residing overseas.

Speaking to Malaysiakini on the sidelines of the parliamentary select committee (PSC) on electoral reform, its chairperson Ambiga Sreenevesan said that denying the constitutional right to vote based on logistics is “appalling”.

“It’s appalling and completely baseless, including their damage control after that,” she said, referring to MCA’s proposal to the committee on the first day of the public hearing yesterday.

“We cannot use logistics to deprive citizens of the constitutional right to vote... Overseas voters, too, are ready to assist in any way to make it work.”

MCA had yesterday told the panel that Malaysians residing overseas should not be allowed to vote as they are “out of touch” with the real situation in the country, and may rely on “doubtful, biased and wrong” information.

Its president Dr Chua Soi Lek later clarified that it is also because allowing these people to vote will pose a logistical challenge.

Count ballots at embassies

"Don't underestimate Malaysians overseas," said Ambiga.

She added that Bersih 2.0's stand is for ballots to be counted at the embassy with the results sent immediately after polls have ended.

In his submission today, Bersih 2.0 steering committee member Wong Chin Huat said that a way to address the logistical issue is to get voters overseas to conduct advanced voting.

He said they will then have to register with the Malaysian mission abroad two weeks ahead so the mission will be able to know which constituencies they will be voting for and how many ballot boxes to prepare.

Wong also suggested that 13 ballot boxes for states and 16 for parliament be provided, instead of for all constituencies and for the ballot papers be sorted when they are counted.

"It is a question of political will," Ambiga said.

Excuses excuses

Meanwhile, at the public hearing, Association for the Promotion of Human Rights’ representative Ramon Navaratnam also disagreed with MCA on the issue.

"Some say Malaysians abroad don't stay in touch, but some people say they know more than we do...they are aware and to disqualify them for being unaware is unjust," he said.

He added that such views by a party that is part of the ruling government gives rise to suspicion that the government is "willy nilly using this (reason) to maintain status quo".

Ramon also disagreed with committee member Fong Chang Onn (BN-Alor Gajah) who suggested that Malaysians should adopt practices in other countries like Australia, that disqualify its citizens who have left the country for more than five years from voting.

BN leaders fighting to say the dumbest thing!

The proposal to allow Malaysians living overseas to vote during general elections has been rejected by the MCA, which announced today that these people are "out of touch" with the country.

Presenting the party's views at the parliamentary select committee on electoral reform, central committee member Ei Kim Hock said extending the vote to Malaysians residing abroad would be unreasonable as they receive "doubtful" information. "Voters residing overseas should not be allowed to vote. We view this seriously as those who reside abroad are out of touch and do not truly understand the situation in Malaysia. "We are doubtful over the kind of information they receive... The future of the nation should be with those who remain in the country," Ei said.

In their memorandum submitted to the committee, MCA said that what Malaysians overseas read about the country is “biased” and “wrong”. “They are getting bits and pieces of news from various sources to try to form a picture of what is happening in the country,” the memorandum read.

Later Datuk Seri Dr Chua Soi Lek has chastised MCA central committee member Datuk Ei Kim Hock for saying the party opposed overseas voting as Malaysians living abroad were “out of touch” with the state of affairs here

“My man didn’t explain it properly ” the MCA president told reporters after attending a Barisan Nasional BN supreme council meeting at the Putra World Trade Centre here

“They came on Wednesday evening to say there must be somebody representing MCA. So we picked one of the nine guys who was willing to go ” he added Dr Chua clarified that the MCA did not agree with overseas voting purely because it presented a “logistical nightmare” as considerable resources would have to be devoted to ensure its success.

Worst still the Star reported today that the Government does not plan to amend the Constitution to enable Malaysians to be registered automatically as voters upon reaching the age of 21.

Deputy Minister in the Prime Minister's Department Datuk V. K. Liew told the Dewan Rakyat Tuesday that this method had its weaknesses and could pose problems if implemented.

He said that due to the high mobility rate, most Malaysians now did not live at the address originally registered in their identity card and did not register the address change.

Another idiot from the government that does not realize that this problems exist weather there is automatic registration or normal registration.

Does the stupid minister thinks that you mobility rate drops after you register yourself normally??

I wonder if the Minister can differentiate the difference between voter registration and updating of addresses?!?

PKR had exposed more documents to show that the NFC had paid RM9.8 million for a unit of the One Menerung condominium in upmarket Bangsar, Kuala Lumpur.

Do they leave the money given to the NLMC in a current account that does not bring big returns while waiting for the satellite farms... or do they invest the money and reap some returns while waiting for the delays to be overcome?” said Khairy.

In a related development NFC executive chairman Datuk Mohamad Salleh Ismail reportedly said at a press conference on 17 Nov that it bought two condominiums at RM6 9 million and rented them out at RM70 000 a month giving a yield of some 12 9 per cent. However this has been serious doubts over this reports according some property experts.

The National Feedlot Corporation (NFC) was able to withdrawn its RM250 million soft loan from the government even before a contract with the government was signed.

This was revealed by Public Accounts Committee (PAC) chairperson Azmi Khalid (right) after the committee interviewed several Agriculture and Agro-based Industries Ministry officers today.

“In this case, the money was disbursed in 2009 into a special account which needs the (relevant) ministry’s approval, to be withdrawn for the company’s operations.

“But only after the money was disbursed (in 2009) was the contract signed a year later in 2010,” Azmi told reporters.

I bet this NFC scandal will go unpurnish along with many other serious corruption scandal.

Leaked cable: Ex-EC chief issued 60,000 fake ICs

A leaked US Embassy cable carries an explosive charge against former Election Commission (EC) chief Abdul Rashid Abdul Rahman - that he admitted to issuing more than 60,000 fake Malaysian identity cards to foreign workers in Sabah in the 1990s on Umno's orders.

The cable, posted on WikiLeaks, quotes former Malaysians for Free and Fair Elections (Mafrel) chief Malek Husin as claiming that Rashid confessed this to him during a private meeting at Rashid's house on Oct 25, 2006.

In the cable marked confidential, Malek is said to have told US Embassy officials that Rashid (left) also confirmed Umno's launch of a "shadowy" campaign in the 1990s to wrest political control of Sabah - held until 1994 by then opposition front PBS.

"During that decade, Umno granted citizenship and Malaysian identity cards to over 600,000 foreign migrant workers (predominantly Muslims from Indonesia and Mindanao in the Philippines) in Sabah, in exchange for their votes in state assembly elections.

"According to Husin, Rashid 'admitted to personally issuing over 60,000 fraudulent Malaysian ICs in Sabah', to help Umno assume political control there," the cable says.

Up to the time of writing, Malaysiakini was unable to get an answer to calls or a text message sent to Abdul Rashid's mobile phone.

Instant citizenship and voting rights for illegal immigrants have long been an issue in Sabah, with local leaders within and outside the BN coalition having repeatedly demanded a solution from the federal government.

However, nothing has come of their demands.

It is claimed that the situation became acute in the 1990s, with the blame placed on then prime minister Dr Mahathir Mohamad for allegedly launching what is now called 'Projek IC' - a clandestine operation said to involve the National Registration Department, related government agencies and their agents - to artificially boost votes in favour of Umno and the BN.

In the 1994 state election, PBS - which had held Sabah as an independent opposition front since 1985 - saw its majority hold of the state assembly reduced to a razor-thin margin over the BN.

Although PBS was eventually toppled with a string of defections to the BN by party stalwarts, many blamed the contentious 'Projek IC' for playing a major role in the success of BN's hostile takeover of Sabah.

Wan Ahmad is 'anti-reform'

The cable, created on March 16, 2007, also includes Malek's claim that Rashid had described EC deputy chief Wan Ahmad Wan Omar as "an Umno member who is anti-reform".

Malek is said to have told US Embassy officials that Rashid had intended to stay on as EC chief until "the number two is gone", with the aim of easing in then EC secretary, Kamaruzaman Mohd Noor, as his successor.

In a separate meeting with Kamaruzaman, the cable quoted him as telling US Embassy officials that the EC was not in a position to push for reforms, as each and every proposal had to go through the Prime Minister's Office for approval.

Kamaruzaman is also reported to have said that the EC has no power to investigate election day abuses, with it having to refer allegations of fraud or election tampering to either the police or the Anti-Corruption Agency, the predecessor of the Malaysian Anti-Corruption Commission.

Battle for polls reform 'very steep'

Based on meetings among US Embassy officials and the EC, Mafrel, Bersih and several academicians, the cable summarised that electoral reforms in Malaysia faced a "very steep uphill battle" as it moved towards the March 2008 general election.

It ironically proved to be a watershed outing for opposition parties, which were able to deny the BN a two-thirds majority in Parliament.

The cable described the "Umno-led BN governing coalition" as keeping a tight rein over all important levers of power, including the EC, leaving little wiggle room for any efforts to open up elections to greater transparency and fairness.

It pointed out that, despite concerted efforts by Mafrel and Bersih to push for grassroots engagement in their bid for a revamp of an electoral system heavily tilted in BN's favour, "their best efforts will almost certainly not produce meaningful reforms", at least in the medium term.

"Umno, in power since independence, faces no effective public, opposition party or internal pressure to reduce its overwhelming powers of incumbency," the cable states.

Real solid proof that BN is going to rigged the up coming General Election!!!

Despite repeated guarantee by the Election Commission (EC) that no foreigner is allowed to be registered as a voter, the verification system of the National Registration Department (NRD) and the EC has shown otherwise.

A permanent resident (PR) holder has been accepted as a new voter in Ijok, the state seat held by Selangor Menteri Besar Abdul Khalid Ibrahim.

Malaysiakini was informed by a reader that a permanent resident named Mismah has been registered in the latest supplementary electoral roll which is now on display for public scrutiny.

A check with the online verification system of both the NRD and EC confirmed the allegation.

The NRD online verification system, which allows users to check the status of an individual by entering the PR card number, shows that Mismah (No. 640704715238) is a permanent resident.

However, when the same number was entered into the EC online verification system, Mismah appeared as a newly-registered voter.

She was registered as a voter in the Ijok state constituency and Kuala Selangor parliamentary constituency, which are respectively held by Khalid from PKR and Dzulkelfy Ahmad from PAS.

A check of the NRD online verification system twice - at 5.48pm yesterday and 11.30am today - had shown that a person named Mismah was a PR holder who had collected her MyPR card (No. 640704715238), an identification card for PR.

When the same number was entered into the Election Commission (EC) online verification system, Mismah appeared as a newly-registered voter.

However, another check with the NRD system at 3pm returned a shocking result - the same Mismah has become a citizen who has collected her blue Mykad.

According to election laws, the EC updates the electoral roll every three months with a quarterly supplementary electoral roll draft.

The names of all newly-registered voters, voters who have changed their residing addresses and voters who have been removed from the electoral roll, are compiled in the supplementary electoral roll draft.

The roll is then displayed usually for one week, for public scrutiny, before it is gazetted and used in the next election.

During the display period, members of the public can raise their objection to the names listed in the supplementary electoral roll.

Allegations of foreigners being illegally registered as voters to shore up the support of certain political parties have been continually raised by the opposition parties but constantly denied by the EC.

EC employs 33 types of vetting

In one of the latest responses in May, EC chairperson Abdul Aziz Mohd Yusof said only citizens are allowed to be registered as voters, and that verification is done through the Agency Link-Up System (Alis) of the NRD.

Through the system, the EC cross-checks with NRD and employs 33 types of vetting before any application to become a voter can be approved.

“During the registration process, the applicant's identifier will be cross-checked with the NRD through Alis. The EC will only process the application if the details tally with the NRD records," he said.

“The system will automatically reject any fraudulent attempts to register a voter."

Tipped-off by readers, Malaysiakini also found other suspicious names on the electoral rolls.

Two eligible voters - Basri Buru Bin Alimin (Mykad: 250622715425) and Soessje Scwanne Jetty Silvana Groeneveld (Mykad: 380424715016) - which appeared on the EC online verification system as voters registered in the Hulu Langat parliamentary constituency, have no record on the NRD website.

The NRD online verification system states 'no application/the number entered is not valid' when the two numbers were entered.

The Election Commission (EC) has denied that permanent residents (PR) have been registered as voters, saying that the cases exposed yesterday could be a result of technical negligence on the part of National Registration Department (NRD).

"I think the list of PR names in the NRD's website was the old one and not updated," said EC chairperson Abdul Aziz Yusof (left) in a text-message to Malaysiakini late last night.
The Election Commission (EC) has changed the status of Mismah, a 'permanent resident' whose name had been entered in the draft electoral roll.

Based on a check of its online verification system at 2pm, under the 'record status', (highlighted in screen capture, right) it is now stated that her application to register as a voter is dalam proses pengesahan daftar pemilih (being verified for the electoral roll).

Her name had been included in the draft supplementary electoral roll that has been opened for public scrutiny for a week.

BEWARE!! THIS IS CLEARLY BN'S WAY OF TRYING TO STAY IN POWER!!!

How nice would it be if all Malaysian are able to speak their mind freely without the fear of being arrested under ISA or be charge for Sedition!

But why do ordinary Malaysian have this fear in them? Is it because we have seen people like Theresa Kok and the Sin Chew reporter Tan Hoon Cheng getting arrested under Section 73 (1) of the ISA in 2008. For just doing their job!

Or could it be because (in 2009) DAP chairman Karpal Singh was charged under the Sedition Act for having expressed the intention to take the ruler of Perak to court?

How does those "sins" compare to Ibrahim Ali who had threaten Christians nationwide with a holy war against any move to usurp Islam with a Christian state.

In that incident he was neither charge or sent to jail under ISA.

I guess you can't blame him for being bolder to now threaten Chinese nationwide with violence!

Yet do we expect any action to be taken against Ibrahim Ali?

During the launch of Perkasa's 'Peace March' yesterday, members of the Malay rights pressure group took to burning and stomping on pictures of Bersih chairperson Ambiga Sreenevasan, a former Bar Council president.

Ibrahim then threatened that chaos would ensue if the rally for electoral reform is not cancelled.

“Imagine, ladies and gentlemen, if the Bersih rally is not called off and they go ahead with it - if they don't cancel it on July 8 or 9 - I believe the Chinese community, many of them, will have to stock up on food at home. Anything can happen on that day."

Perkasa has called for a counter-rally dubbed 'Peace March' on July 9, while Umno Youth also plans to hold a simultaneous rally to defend the current electoral system.

But the electoral system is very screw up! Here is prove!

Wikileak shows What US thinks about the Perak Constitutional Scandal!

The notion that the Malaysian judiciary is not independent has been reinforced by rulings delivered in the legal saga that followed thePerak constitutional crisis in 2009, according to US diplomats.

It was also noted that well financed political coalition like BN could persuade members of parliament to support the other side, thus shifting power through undemocratic means.

These views were revealed in a WikiLeaks cable made available toMalaysia Today.

The cable quoted comments from a US embassy official that questions had already been raised on the independence of the judiciary in connection with the Anwar Ibrahim trials and other cases.

“This Federal Court decision in BN's favour (in Perak) raises renewed questions about the independence of the Malaysian judiciary,” the cable said.

“Before the Federal Court decision, the (Perak state) assembly would have instead been dissolved for fresh elections but now the sultan can legitimise the takeover without voter input.”

The diplomat noted that, while the government argues that the decision was based on a sound interpretation of the Perak constitution, the opposition had criticised the verdict as legitimising illegal political manoeuvering to change the outcome of democratic elections.

“This sets a dangerous precedent by implying that the (Agong) could remove the prime minister, without a no-confidence motion in Parliament,” the official said.

The Federal Court's 5-0 decision on Feb 9, last year ruled that Pakatan Rakyat menteri besar Mohd Nizar Jamaluddin could not continue to govern Perak when he had lost majority support in the state assembly.

Chief Judge of Malaya Justice Arifin Zakaria (left), reading out the 41-page judgment, said that to allow Nizar to do so would be against the principle of democracy. However, Arifin said this is by no means the end of the matter.

"It is always open for the appellant (Nizar) to bring a vote of no confidence against the respondent (BN's Zambry Abd Kadir) or make a representation to the sultan at any time if he thinks the respondent does not enjoy the support of the majority of members of the legislature," he said.

The bench, led by the President of the Court of Appeal Justice Alauddin Mohd Sheriff, then declared Zambry the lawful menteri besar.

The other three judges were Justices Zulkefli Ahmad Makinuddin, Mohd Ghazali Mohd Yusoff and Abdull Hamid Embong of the Federal Court.

Spotlight on royal powers

The cable further noted that the powers of the sultan had come under scrutiny because replacing a chief minister or menteri besar is not mentioned in the Perak constitution.

By virtue of the unanimous court ruling, Sultan Azlan Shah (right) of Perak would have the authority to appoint a new menteri besar if he believes that a different political coalition commands the majority of seats in the state assembly.

The diplomat noted that the only way to fairly resolve such a crisis would have been to hold snap election, as Nizar had sought to do in seeking an audience with the sultan.

Diplomats who interviewed some of Nizar's lawyers over the Federal Court verdict described the decision as a “political decision” rather than a “constitutional decision”, and said such a verdict would result in it rewriting its past decisions and the constitution.

Nizar was also quoted by the diplomat as saying that the ruling would result in a “dangerous precedent” where the prime minister or chief minister holds office at the pleasure of the Agong or sultan.

While Prime Minister Najib Abdul Razak had appealed to everyone to respect the court's decision, Anwar was quoted in the diplomat's report as saying that Umno and BN "do not have the courage to face the people" in elections.

DAP leader Lim Kit Siang was quoted as calling it a "legalisation of BN's coup d'etat."

A NGO today claimed to have video proof that BN had indulged in vote-buying in the recently-concluded Sarawak election.

The Malaysian Election Observers Network (Meonet) put up a video of a tuai rumah or longhouse chief in the Tamin constituency, who apparently admitted to receiving RM10,000 on behalf of his longhouse to support BN.

Tamin was won by BN through PRS candidate Joseph Mauh Ikeh, who obtained 4,998 votes, a 1,292-majority over PKR's Mengga Mikui, who finished with 3,706 votes in the predominantly Iban area.

In the nearly six-minute video - done almost entirely in the Iban dialect - the longhouse chief claimed that some BN representatives gave him three cheques, with the biggest valued at RM5,000, on the morning of April 13.

It is understood that two other cheques, valued at RM2,000 and RM3,000, were given earlier.

“Dulu nadai, RM20 aja bagi nya (We got nothing in the past, they only gave RM20),” the headman said when asked if his longhouse had received that much in cash handouts in previous elections.

Meonet coordinator Ong Boon Keong said the video was shot yesterday after they received information from one of their observers.

Ong said the three cheques were issued to the longhouse development and security committee, on top of RM50 handouts given to 14 heads of families living in the community.

When asked if all in the longhouse voted for BN, the headman simply said, “Bisik mangkah” (We did mark), referring to the act of marking 'X' next to a voter's party of choice on the ballot paper.

The longhouse chief however admitted that the longhouse residents “nadai untung”, or gained nothing, after voting for BN for the past 25 years but felt obliged to vote for the ruling party as they had already been “bought”.

This news just piss me off!!

Where is the funds coming from?? If the govt is using the rakyat's money then that will really piss me off!!!
