Justice done but still undone! TBH!

Why!? After reading certain section of the RCI Report on TBH, I can see that the RCI really shot the MACC really bad! But after everything they said, they still think that TBH committed suicide?!? Makes no sense!

Just to give you an idea, the following is what the RCI said in their report.
1. They said that the MACC officer interrogation was aggressive, relentless, oppressive & unscrupulous.

2. He was involuntarily escorted to the MACC building where his mobile was confiscated and his lawyer was denied access to him.

3. He was then verbally assaulted by a pack of 6 officers!

4. RCI called this an inhumane treatment which TBH and to endure (this torture) for 4hours! Worst still this was only the first of 4 interrogation stages which TBH had to go through!

5. Arman and Ashraf (MACC Officers) instilled fear and doubt in TBH through false statements!!

6. Arman & Ashraf (A&A) were either stupid or in a deplorable act, they intentionally exploited TBH lack of knowledge deliberately with the aimed to confuse TBH.

7. A&A force TBH to disclose the password to his private e-mail account which is a gross violation of a person's right

8.The RCI Report said: "Arman was certainly a bully..." and found Ashraf evidence most unreliable.

9."...threats of physical harm were most probably used by A&A when interrogating him"

10. In the 3rd interrogation, Nadzri (another MACC Officer) deliberately prolonged this process to torture TBH mentally and disorientate him to agree to turn against his boss out of despair.

11. RCI also mention that what Selangor MACC did was not only inefficient wok but also illegal!
And these actions by the MACC officers cause TBH to commit suicide.

12.Contrary to what MACC reported, RCI believe that TBH was not released. He was still under detention by the Selangor MACC.

13. The main MACC officer incharge called Hishammuddin Hisham (HH)... RCI had this to say about him.
"...We found him to be arrogant, given to falsehoods, untruthful and uncompromising in his stand. His falsehood, particularly of his nonactive involvement in the entire operation at the material time, were exposed from the contradictory statements he made before us. But more compelling was the confirmation from 2 of his own officers,..."
14. Read how RCI further describe this HH guy...
a. "We were unable to accept the testimony of HH ..as the truth..."
b. "No reasonable man would be able to accept as true the story of HH.."
c. "No person in their right mind would believe HH...."
d. "...HH was just to stubborn to retreat from his mistake... To overcome his disappointment at the negative results....he must have resorted to a personal and more aggressive interrogation of TBH..."

THIS GUY IS THE...Deputy Director of the Selangor MACC at that time, holding the rank of senior assistant commissioner 1 and with MACC for 19 years!
He is currently the Director of MACC N.Sembilan...
NOTE THE PROMOTION!!!!

RCI also mention that the expert called in (Prof Mullen) said that TBH was firmly in the lowest risk group for suicide when he was taken into MACC custody!
According to the other expert brought in (DrBadi'ah and Dr Hayati), TBH came from an intact family and had a stable job. Having no history of mental illness, impulsivity or substance abuse, TBH would be in the low-risk category for suicide. In fact he was looking forward to his wedding and his fiancee was then pregnant.
RCI also mention that based on family and friends, TBH was hardworking, diligent, responsible, devoted to his family, loved children, and was faithful to his boss.

We (RCI) note that TBH 's relationship with his boss, YB Ean, was a mutually cordial and respectful one.

Based on the RCI report it is clear who killed (directly or indirectly) TBH!!!

We must demand from the government that justice to be serve!!! NEVER FORGET!!! NEVER LET THE GOVERNMENT FORGET!!!

WE MUST DEMAND CLEAR ACTION FROM THE GOVERNMENT!
Let what happen to TBH and Ahmad Sabani never again happen to anyone in Malaysia!

VOTE FOR CHANGE!!

Most cruel judgement by Malaysia's Judges to date!

He was detained under the Internal Security Act (ISA), tortured both physically and mentally, forced to drink urine - and now he has to pay RM70,000 to those who tortured him.

abdul malek hussin mafrel interview 140806 lookThanks to the President of the Court of Appeal alaudin md sheriff, Federal Court justice hashim yusof and mohd ghazali mohd yusoff!

Abdul Malek was arrested under the ISA on the night of Sept 25, 1998, after addressing a demonstration earlier that day in Masjid Negara following the sacking and arrest of Anwar (right), who was then deputy prime minister.

He was detained for 57 days, and was later released without being charged. He then filed his civil suit in March 1999.

stripped naked in an air-conditioned room, blindfolded during interrogation, andphysically assaulted up to 60 times, beaten until he was unconscious, forced to drink urine and subjected to sexual abuse.

He also told the court he saw the then inspector-general of police Abdul Rahim Noor punching him in his chin in the interrogation room when his blindfold accidentally dropped.

High Court judge Mohd Hishamudin Mohd Yunus also ruled in 2007, that the assault by Rahim did indeed take place as there was no denial and also there was no report lodged against Abdul Malek for falsifying his report.

HOWEVER!!!!

The Federal Court had yesterday (12 Aug 2010) upheld the appellate court's decision to overturn the High Court's rare judgmentto award Abdul Malek RM2.5 million over unlawful detention.

NONEIn fact, the apex court also ruled for Abdul Malek to pay RM20,000 to the respondents - special branch officer Borhan Daud, the then inspector-general of police Abdul Rahim Noor (right), and the government.

This is on top of theRM50,000 that the Court of Appeal ordered him to pay in costs back in March.

THAT IS RM70,000 ALTOGETHER!

This judgment that could potentially bankrupt him, and with absolutely no more legal recourse, he will now have to turn to help from the public for funds.

Despite that, former Internal Security Act detainee Abdul Malek Hussin (left) has vowed to soldier on.

"I don't know what I can do now. We may have to set up a fund or get help from the other NGOs.

"I don't like the idea, really. But I cannot be declared bankrupt because it would then mean that I have to forfeit a lot of job responsibility," said Abdul Malek, who is now the parliamentary affairs coordinator for opposition leader Anwar Ibrahim.

He said that he will also be in touch with human rights NGO Suaram and there will be a meeting on Monday to discuss the next course of action.

'Ruling is cruel'

When contacted byMalaysiakini, he also slammed the judgment, calling it "cruel".

"They dismissed my leave application. They wouldn't even listen to my case first. This is so cruel. At leastbagi jalan (give way) to listen lah.
"I think the judiciary is scared," he charged.

"The judiciary is supposed to be a bastion for citizens to seek justice. The idea of citizens going to court is primarily to seek justice. Here, the judiciary backs the authoritarian regime. Gone lah.

"(The courts) have failed in their responsibility to impart justice in defence of human rights and against authoritarianism," he said.

He added that with the judgment, the government's exercise in reviewing the ISA will be merely cosmetic.

News like this just make me ashame of my judiciary system! How I wish the BAR Council would be more vocal against such injustice!

Make me one to track all the idiot injustice done by our judiciary.

So far I can remember are the Anwar Sodomy Cases (with regards to evidence), The Perak Government Case (Sivakumar, Nizar and Menteri Besar), The Election Commision issues. Can't remember the rest. At least there is still this website(and also this website) that gives a good start! If anybody else has anymore to add just leave a comment!

Interestingly these 3 Judges, (alaudin md sheriff, Federal Court justice hashim yusof and mohd ghazali mohd yusoff) has interesting pass.

hashim yusof is the judge that Karpal Singh named as the Federal Court judge who failed to deliver about 35 judgments.
One of the 5 judges that was involved in the Perak bias judgement.
And finally alauddin, the judge that ruled on Apr 16, 2009 that Perak Assembly Speaker V Sivakumar does not have the power to suspend Mentri Besar Datuk Zambry Abd Kadir and six state executive council members from attending the assembly. It is a decision that was made in blatant defiance of Article 72 (1) of the Federal Constitution which says,”The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court”.

Nazri follow his boss and acts stupid!

Or is he really that stupid! (got this article from straight talk)

Minister in the Prime Minister’s Department Mohamed Nazri Abdul Aziz commented on the Bar Council's decision to sue the government over the detention of five lawyers at the Brickfields police station for discharging their duty.
Nazri said:
"The decision by the Bar Council to sue the government over the May 7 detention of five legal aid lawyers is an attempt to intimidate the enforcement authorities from discharging their duties."

Hello...Nazri, wake up! If the police have kept to the rule of law when discharging their duties they would not have detained these lawyers who were there to play their role.
Who were detained in a cramped detention cell? Not the police.
So, who is intimidating who? Duh!

He said it also showed that the legal practitioners themselves wanted to undermine the country’s legal system.

Suing the government means undermining the country's legal system? Detaining lawyers who were discharging their duties is really undermining the rule of law and the legal system.
Nazri, wake up! for the second time.
Are you sure this guy was trained as a legal officer?

“The Bar Council is supposed to be a role model. If police enforce the law and among those caught are their (Bar Council) members, they have to accept it. We have the judiciary. Let the court decides whether the five lawyers are guilty or not."

Yes Nazri, this what the Bar Council is doing by taking the government to court!!
Yes, let the court decide if the police did the right thing in detaining the lawyers.
Nazri is famous for his outrageous statements. Folks!
The court (PM's Department) jester is back! And he did not disappoint.

Bar Council's forum: More shelling for police

As reported by Malaysiakini
Aug 12, 08 5:43pm
Twelve non-governmental organisations today signed a joint statement, denouncing the high-handed action taken by Muslim protestors and the police to stop an open discussion on legal issues related to the conversion to Islam.

Organised by the Bar Council and held last Saturday, the open forum entitled ‘Conversion to Islam’ was forced to end early on the advice of police after an unruly demonstration outside the meeting hall threatened to get out of hand.“The blatant double standards employed by government and police in dealing with the protestors and the forum subject raises questions about the even handed and fair treatment accorded to all religions,” the NGOs said in their joint statement. The NGOs also blasted the police for bowing to pressure from the protestors instead of protecting the Bar Council. Some Muslim groups have vigorously opposed the dialogue on the fear that it could be used as a platform to provoke sensitivities and criticise their religion. The government too has been reluctant to promote open interfaith dialogue on the grounds that it could incite racial discord.

The NGOs however rebutted that while it was necessary for Malaysians to be mindful of religious sensitivities, extreme acts aimed at curbing legitimate public discussion should not be condoned.“In the Bar Council’s case, the forum was aimed at helping clarify legal and administrative provisions on religious conversion issues which could have provided useful inputs on helping resolve recent controversial developments,” the group said.“In fact, the organisers had taken the initiative to invite distinguished speakers from the Federal Territory Religious Affairs Department and Institute of Islamic Understanding Malaysia, although both withdrew after the forum was demonised by some quarters,” the NGOs lamented. The group also expressed disappointment that parliamentarians from PAS (Sallahudin Ayob) and PKR (Zulkifli Nordin) were actively involved in the protest.“Finally, we note with concern and condemn the petrol bombs attack directed at the previous house of Bar Council president Ambiga Sreenevasan. We hope that there is no connection between that act and the role of the Bar Council in organising the seminar and call on the authorities to fully investigate that action and bring the perpetrators to book,” said the NGOs.

Abusive language 'un-Islamic'Meanwhile, Pergerakan Progresif Mahasiswa Islam (Promis) and Jaringan Rakyat Tertindas (Jerit) have also condemned the aggressive nature of the demonstration.“The use of abusive language, aggression and threats to halt the forum are un-Islamic, undemocratic and goes against the principles of Islam,” Promis said in a statement.“We also condemn the act of passing judgment on the forum based on assumptions only.”Promis said instead of disrupting the dialogue, the protestors should have first attended the forum to find out if it was really aimed at insulting the religion.“If they (the leaders) were not even inside, how would they know if the forum was aimed at attacking Islam. It would have been better if the protestors attended the forum and gave their own views and opinions instead of sullying the image of Islam,” it added. In a separate statement, Jerit said: “Freedom of religion is fundamental human rights enshrined in the Universal Declaration of Human Rights (Article 18) and guaranteed by the Federal Constitution (Article 11).“This basic constitutional right should not be overruled by the authorities or by mainstream interpretation of religion.”

Criticisms from MCA MCA politicians also spoke out against the conduct of the protestors, with the party's Wanita deputy chief Chew Mei Fun stating that issues should be allowed to be discussed."We cannot just treat every issue as sensitive. In fact the Bar Council forum was a platform for various groups to engage in discussion in a peaceful manner in seeking a solution."The organizers did not intend to confront anybody but to hear the different perspectives and sought to find a solution to avoid these issues from repeatedly occurring," said the former PJ Utara MP.
Meanwhile MCA publicity bureau chief Fu Ah Kiow was of the opinion that the government had taken too long to resolve the various religious conflicts in the country."This issue has been in existence even before the Shamalah case and the government has taken too long to resolve this issue. People want to see action. They don't only want to hear promises by the government."Where a spouse or family member has embraced Islam, the conversion effectively has an effect on the non-Muslim family members since it involves human rights with regards to the welfare of family members who have not converted."There are custodial problems where minor children are involved, and inheritance issues too," said the former deputy minister.
MCA Youth legal bureau head Gan Ping Sieu said their movement strongly supported the Bar Council in holding such forums."The bureau hopes that Bar Council will continue to conduct similar programs to discuss conversion issues in the future and it is not afraid to state its stand on the matter."At the same time, the bureau also advises political leaders not to issue irresponsible statements in trying to distort the real issue at hand," said Gan.Former MCA vice president Chua Jui Meng said the protests which shortened the forum was an embarrassment to the political leadership and police force of the country."The fact remains that on one side the Bar Council was lawfully holding a forum in its own premises and on the other was a mob hurling racial abuses which were seditious and unlawful," said Chua."
The rakyat will also wonder why the police force, which have proven so effective in dispersing demonstrations of over 10,000 people before were this time unable to contain a 300 strong mob."The rakyat will certainly expect to see arrests and prosecutions being made against those involved in this protest," said the former health minister.Pua critical of MCA reactionIn reaction, Petaling Jaya Utara MP Tony Pua was somewhat critical of MCA.In his statement, the first-time MP said: "We have read with interest that the MCA leadership has come out strongly via statements to the media the party was "extremely upset at the protesters' actions".
But Pua noted that following last Saturday's incident both the prime minister and his deputy had spoken out against the forum."The Prime Minister, the Deputy Prime Minister and other top leaders from UMNO has been unapologetic and even threatening in their condemnation of the forum conducted by the Bar Council," said Pua."Therefore, while we welcome MCA's views on the controversy, they must face up to their responsibility to challenge the views of the Prime Minister and Umno, who are clearly abusing the race and religious card recklessly to create an atmosphere of fear."
It is noteworthy that while the protesters were condemned, no comments were forthcoming on the opposing views espoused by the Umno leaders.Pua argued that without doing so, it would appear that Barisan Nasional is perpetuating its system of divide and rule, where Umno stokes the racial and religious sentiments of Malays while MCA plays its subservient role to placate the minority communities."That will only strengthen the case that MCA has lost it total relevance in Barisan Nasional."
