Education Minister Datuk Seri Hisham-muddin screw up again!













TheStar reported that..... NEW Umno vice-president Datuk Seri Hishammuddin Tun Hussein had made the following statement at the party general assembly

"the process of independence and later developments were forged by “Umno and our Malay Rulers and no one else”.

This of course piss off a lot of Malaysian !
So how did he do damage control?!?
I think he took a lesson from Syed Hamid














(which is not a very smart thing to do lah!)
1. Say that you were taken out of context!
2. Blame the media for turning this into a racial issue and warn them to be more responsible in their reporting??!

I have a few question of my own!
1. Why are BN leaders so often misquoted ah?!? (see prove here!)
2. If you look at Hishammudin statement, is that or is that not a racial statement he made himself???!
3. Should the media be more responsible in their reporting or should Hishammudin be more responsible in his statement?!?!
4. Has Hishammudin not learn from his pass keris issue??!

More Bias Persecution by BN!

Malaysiakini Reported: The DAP is furious with Barisan Nasional's continuous use of the police to trample on political freedoms in the country. They said that BN was increasingly resorting to use the police to "systematically harass and impede the free exercise of political freedoms".

The latest act by the police in arresting the party's Tebing Tinggi assemblyperson Ong Boon Piow.Ong was arrested last night at about 10.30pm at the Chin Woo Hall in Ipoh during a film screening organised by Perak DAP.He was arrested for allegedly violating the Film Censorship Act 2002 for "manufacturing, circulating, distributing, displaying" the ‘Democracy Tree' DVD without first getting a B certificate from the Film Censorship Board.

QUESTION!
1. WAH?!?! Are our Malaysian police suddenly so efficient in enforcing this section of the law?!?!
2. Then what about all those illegal DVDs and VCDs being flaunt on the streets and malls all over Malaysia?!?
3. Are the police going to catch them next?!?!?Party veteran Lim Kit Siang added in to say that this was the latest example of the increasing intolerance towards fundamental liberties in this country.

He said these were ominous signs of increasing repression in Malaysia under incoming Prime Minister Najib Abdul Razak.

Other similar "escalation of oppressive state actions" include:
1. Party chairperson Karpal Singh being charged with sedition for saying he would file a suit against the Sultan of Perak.
2. Sedition investigations against the party's state representative in Johor Dr Boo Cheng Hau over his 'apartheid' remark.
3. The one-year suspension of DAP MP for Puchong, Gobind Singh Deo without parliamentary pay and privileges.
4. The three-month suspension of Harakah and Suara Keadilan.
5. The indiscriminate and high-handed police action against Pakatan Rakyat gatherings and ceramahs.

Serious question lingers over Najib's Premiership!

This is an interesting article in Malaysiakini!
I thought I highlight a very interesting section from it!
These are unanswer question that are very worrying!

Private investigator P Balasubramaniam and his entire family mysteriously disappeared a day after he revealed a sworn statement giving intimate details incriminating Najib to the murder case in July 2008. Despite promises to investigate, the police have remained silent over the contents of this affidavit. And the court had also barred the admission of this document.

Why did the police and the court keep a safe distance from this document that could have led to a breakthrough of this trial?

What has happened to Balasubramaniam and family – as nobody seems to know their whereabouts?

Why further evidence by Altantuya’s cousin Burmaa Oyunchinmeg when she testified that Najib appeared in a photograph with Altantuya blocked?Why did the court block further evidence upon revelation in court that Malaysian immigration records of Altantuya and her two Mongolian companions had been mysteriously erased?

Shouldn’t such erasure have been considered an important lead and an indication that some VVIP was involved?

Why were Najib and his aide-de-camp Musa Safri not investigated and called to the witness stand, since it was Musa who gave instructions to the first accused (first and second accused were Najib’s bodyguards) to solve third accused Abdul Razak Baginda’s ‘woman problem’.

Now that Razak Baginda (a close associate of Najib) has been declared innocent, we are now left with the bizarre scenario of a murder without a motive, since the first two accused had no motive on their own to kill the victim.

What will this mean for the 2 accused?!?!

First it was Suara Keadilan and Harakah...
Then The Rocket Publication (the oldest Chinese political newspapers in the country) is having problems with their permit!
Does it looks like Malaysiakini and gang is set to be UMNO's next target against freedom of the press???
At least six new media publications including Malaysiakini have been denied media accreditation by Umno to cover the party's annual general meeting beginning today.

And as usual, our sleepy friend Abdullah appeared to be in the dark when he was asked about the ‘ban' on the Internet media.

He then asked Tengku Adnan for an explanation.
Tengku Adnan response was..."They are banned for irresponsible reporting. If your report responsibly, we will allow you to come."The way you report about our leaders (and) our party is 'sickening'," he added.
Irresponsible Reporting!?!??
HUH!?!? I think these are the most responsible group of reporters in whole country!!!
When you talk about irresponsible reporting, I can think of other news media that are much bigger culprits!
AND THE BIGGEST JOKE OF THE DAY!
(according to Malaysiakini) During Najib's opening speech at Umno’s 59th annual general assembly in Kuala Lumpur tonight, Najib said: “We cannot regard the new media as our enemy.”


Is he confuse?!?!?
Is he doing what comes out from his mouth or is it just sweet empty promises to make people happy?!?
Does he think we will believe what he say or do?!?
Will we be surprise if he moves in on cyberspace to restrict freedom of press, purely for his own selfish agenda!?!?!?

Latest unfair Abuse of Power by BN!

The latest unfair abuse of power from BN is barring Selangor's elected leaders (from Pakatan Rakyat) from visiting government schools in the state.
This is a directive issued by Education Minister Hishammuddin Hussein (pic below).The education minister has appointed 73 Umno, MCA, MIC and Gerakan leaders who were sanctioned to attend official events in the state's schools.
BUT NONE FROM PAKATAN RAKYAT!
Is BN really getting more and more desperate and insecure?!?!
Is BN willing to let the rakyat suffer just so that they can stay in power?!?
Does BN leaders have no sense of fairness and integrity at all?!?!?
In other news, the Federal Court today ruled that Umno Wanita chief Rafidah Aziz was rightfully elected as the Kuala Kangsar member of parliament despite her not fulfilling certain nomination requirements.
On July 4, Ipoh Election Court jdge Justice Zakaria Sam ruled that Rafidah's "silly mistake" in failing to sign two out of three sets of her nomination papers in the March 8 general election was not a proper reason to nullify the final outcome.
Stressing that "it was a mere technical error.'"It was a silly mistake by the candidate (Rafidah) but it was not an obstacle or hindrance for having the election," said Zakaria.
I wonder if Pakatan Rakyat candidates would be given such grace if they had made the same mistake?!?!

Can you all out there stand this unfair, bullying, abuse of power tactic that you see happening in Malaysia?!?

Have you seen the Made-in-Malaysia car 'Kancil'? You know, that very little 600 cc car ???
Well, Najib really wanted to sell it to the US , so when Najis paid a visit to the White House after finishing formal discussions with George Bush, Najib checks with Bush to find out if there is a way to sell the Kancil in the USA .
After having looked at the brochure, Bush said, You know, I think this 'Kernchill' is too small for us Americans.
Not one who gives up easily, Najib persisted and finally Bush offered, 'Ok, take this number down. This guy is my good buddy and he's also the CEO of the biggest compact car distributor in North America '.
Nijib was satisfied with the meeting and returned to Malaysia. The next day he called the number and a lady answered, 'TOYS R US', Can I help you'

There are three major races in Malaysia - Malay, Chinese and Indian The Malays have the political power and so they set up the party UMNO, which literally means 'U Must Not Object'.
The Chinese, on the other hand, controls most of the economy and they called their party MCA which means 'Money Conquers All'.
Then there are the Indians who have no say in politics or economics. They set up their party called MIC. Hence, every parliamentary meeting the Indians would ask: 'Must I Come?'

Harakah, Suara Keadilan banned 3 months, WHY?!?

Are Malaysian surprise that this is happening just before major by-election campaign?!?
Is it not bad enough that the BN has all the major news media under their control?!?
Are they so insure that they can't even let the small publication have a little bit of freedom of press?!?
Thank God we still have the internet!!
I wonder if this is going to be Najib's style of rule when he becomes PM!?!?
Is he going to be the dictatorial tyrant style that a lot of people are predicting that he is going to be?!??
Even theStar could not give a reason for the ban!
I like to hear from Syed Hamid Alba his reasons for banning the two publication!

THINGS THAT MAKES NO SENSE!!

Today in the Sun newspaper there was this article and it just makes no sense!?!

Maika Holdings Bhd chief executive officer Vell Paari (Samy Vellu's Son) told the coroner's court here today that he never had sex with his personal assistant K. Sujatha.









He said his relationship with her was close and normally when he visited Sujatha at her condominium unit in Jalan Ipoh, it was for official reasons and if there were functions there. He said he never paid her casual visits.



(What possible official reasons could you have to go visit her in her condominium?!!?)

(All the resources of your father at hand and you have function in your personal assistant's condo??!? Don't make sense lah!)





In the article, Samy Vellu's son..........
1. Accompanied Sujatha twice to India where she sought medical treatment
2. Took Sujatha, her father and two brothers with him in a visit to Australia.
3. Funded Sujatha to pursue her diploma and masters in commerce.
4. Funded Sujatha's brothers for their studies in Australia.
5. Paid RM220,000 for the codominium unit where Sujatha had stayed and stood as a guarantor for a bank loan amounting to RM200,000.
6. And also stood as a guarantor for a loan on the Mazda RX8 used by Sujatha.

Malacca Chief Minister Datuk Seri Mohd Ali Rustam who has been found guilty of election offences by the Umno disciplinary board and barred from contesting in the party election next week.

Lim Kit Siang is right!
1. How can the guy be deem unfit to run for election in UMNO but deem fit enough to remain as the Chief Minister of Malacca?!?
2. How come MACC is so slow in acting on this matter?!?

Attorney General has proceeded to charge Karpal Singh under the Sedition Act 1948 for his statements on the issue of removal of the former Perak Menteri Besar Datuk Seri Nizar Jamuluddin by Sultan Azlan Shah.

Howcome charge him with sedition and not charge Mahathir with sedition.

Afterall, wasn't it Mahathir administration that allowed Kapal Singh to take the rules to court?!?
So why didn't the AG charge the following UMNO leader with sedition!?!??!

The arrogance of a novice judge

NH CHAN is former Court of Appeal judge.
He gave his verdict on the Constitutional Crisis in Perak.
His article is too long and complicated for most normal person to read.
So I shall attempt to summarize it up for all my friends!


I must say I was taken aback by the astonishing ruling of Ridwan Ibrahim, a High Court judicial commissioner.

perak state assembly and v sivakumarHe ruled that the lawyers “engaged by (Perak assembly speaker V) Sivakumar (left) had no locus standi to represent him in an application by Perak Menteri Besar Zambry Abdul Kadir, who is seeking a declaration that Sivakumar’s decision to suspend him and his executive council was unconstitutional and unlawful”.

I am appalled at the arrogance of the judge. I am quite sure he is not an expert in constitutional law and even if he were, in a case of such great public importance to the nation, it is wise to listen to the views of the other side. Especially in this case, when eminent counsel Tommy Thomas was available to assist him.

The judge could have invited him to submit as an amicus curiae - in Latin it means ‘friend of the court’ and when the phrase is used in a court of law it means ‘one who advises the court in a case’. I have done that many times even when I was in the Court of Appeal.

Judges of far greater eminence than this judicial commissioner have often asked lawyers of great experience who are in the court for their valued views. Yet this judge thought he knew everything that he did not require any assistance from one of the top lawyers in the country.

malaysian law conference 301007 tommy thomas 2In order for the judge to tackle all sorts of cases which come before him, the wise and able judge is always humble enough to ask any of the lawyers in court who is an expert in his field for assistance.

Here we have Thomas (right), who is one of the top lawyers in the country only too willing to assist the judge, yet this probationary judge, who thinks he knew more about law than some of the most eminent judges who have sat on the bench, refused to hear him out.

Here’s how to judge the judge
You cannot judge a judge unless you know the basic law yourself. But you do not have to worry because I shall now provide you with the law applicable so that you are in a position to judge the judge.

You may be surprised at your own ability after you have read this. You might think that even a layman, after reading the applicable law, knows what is the right decision to make. And when a judge does not know the correct answer, it makes you wonder how such a thing could have happened.

Section 24 of the Government Proceedings Act 1956. Sub-sections (1b) reads:

"in.civil proceedings by or against the Government of a State, a law officer ... authorised by the Legal Adviser of such State ... may appear as advocate on behalf of such Government...".

As you can see, this sub-section is not relevant as it only applies to civil suits brought by or against the state government, not a public officer.

And sub-section (2b), which is relevant on the subject of discussion, reads:

"In his personal capacity, if the Attorney-General certifies in writing that it is in the public interest that such officer should be represented by a legal officer; a legal officer :may appear as advocate on behalf of such officer...”.


perak state govt crisis 030309 pakatan lawyersThis sub-section only applies to civil suits brought by or against a public officer. In such a case, a public officer may (the word is 'may' not 'must') be represented by a legal officer which could include the legal adviser of the state.

Therefore, there is nothing in section 24 (2) of the Government Proceedings Act to suggest that a public officer if he sues or if he is sued must be represented by a legal officer such as the state legal officer.

In any case, section 24 (2) of the Government Proceedings Act only applies to civil proceedings to which a public officer is a party.

Therefore, the question is, does the speaker of the Legislative Assembly of a state hold office as a member of the public service? If he does, then he is a public officer.

Article 132, Clause (3) of the Federal Constitution states that:
“(3) The public service shall not be taken to comprise -
(b) the office of President, Speaker, Deputy President, Deputy Speaker or member of either House of Parliament or of the Legislative Assembly of a State.”

So now you know that the speaker and the members of the Legislative Assembly of a state are not part of the public service as they do not hold office as public officers. Therefore, section 24 (2) of the Government Proceedings Act does not apply to them.

Now we all know, except the judge because he thought he knew better, that Thomas could not be prevented to appear for the speaker Sivakumar. If only he had heard Thomas out, instead of barring him from speaking, he would not have made such a grave error.

Courts can’t question validity of assembly decisions
dr zambry abdul kadir new perak cm 110209 03According to newspaper reports, the case is an application by (BN-appointed menteri besar) Zambry Abd Kadir to the court to declare the decision of speaker Sivakumar in the legislative assembly to suspend him and his six exco members as unconstitutional and unlawful.

The question is, can the courts decide on the validity of the proceedings in the Legislative Assembly?

The answer is staring at us right here in the Federal Constitution. Article 72, Clauses (1) to (3) states:

“(1) The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court.

(2) No person shall be liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the Legislative Assembly of any State or of any committee thereof.

(3) No person shall be liable to any proceedings in any court in respect of anything published by or under the authority of the Legislative Assembly of any state.”

So now you know from the Federal Constitution itself that the validity of the suspension of Zambry and his six exco members by the speaker in the state assembly cannot be questioned in any court.

From what we have read from the newspapers, it seems that there is an injunction against the speaker.

You may wonder how an injunction can be obtained against the speaker when our written constitution says that“no person shall be liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the Legislative Assembly of the State”.

YOU WILL PROBABLY BE JAIL IN ISA IF YOU TRY TO ANSWER THAT QUESTION!!

Sultan has no powers to ask Nizar to quit

NH CHAN is former Court of Appeal judge.
He gave his verdict on the Constitutional Crisis in Perak.
His article is too long and complicated for most normal person to read.
So I shall attempt to summarize it up for all my friends!


According to the Perak constitution, the ruler has a personal discretion in the performance of two functions : - This is provided for in Article XVIII, Clause (2)
- the appointment of a menteri besar and
- the withholding of consent to a request for the dissolution of the legislative assembly.

On Feb 4, Mohd Nizar had an audience with the sultan to seek the ruler's consent to dissolve the state assembly.

However earlier in the day, Najib, who is Perak Barisan chairman, had an audience with the sultan twice.

Later Mohd Nizar was summoned to an audience to be informed of the sultan's decision not to dissolve the state government.

Now what is wrong with that?

It is wrong because the sultan saw Najib without Mohd Nizar being present.

As a former Lord President, who was then the highest judge in the country, the sultan should know that it is improper to see an interested party alone without the other side being present before announcing his decision.

That was his undoing. It was a fatal error. This is not a case of natural justice where both sides have a right to be heard. BUT there was no hearing.

The personal discretion to grant or not to grant (for dissolution of the State Assembly) must be exercised without any suggestion or suspicion to any reasonable outsider that he was partial to one political party or coalition of parties.

In other words, it is about the appearance of impartiality - justice should not only be done, but should be seen to be done.

It is very sad that Sultan Azlan Shah, who had been held in high esteem internationally and by the populace, has, in a careless moment, lost all that.

His reputation for fairness and justice has been shattered when they go away thinking that he had been influenced by Najib or that he has favoured BN. It does not matter whether he did, in fact, favour one side unfairly.

Suffice it that reasonable people might think that he did. The die is cast and we cannot put the clock back. Hereafter, there may be many who will no longer believe in his speeches on good governance and the integrity of the judiciary.

The impression is that he does not practise what he preaches.

When the menteri besar ceases to command the confidence of the majority of the members of the legislative assembly, he has two choices.


First, he may request the ruler to dissolve the assembly for the purpose of a state election. Second, if his request is turned down by the ruler, "he shall tender the resignation of the executive council”
This is provided in Article XVI, Clause (6).

The sultan is a constitutional monarch who has no power to rule except a couple of discretionary powers mentioned in Article XVIII, Clause (2). (see above)

So, apart from the couple of matters mentioned in Article XVIII, Clause (2), the Sultan of Perak has no power to order Mohd Nizar to resign from his post as Perak menteri besar together with the members of the state executive council with immediate effect.

Nor has he the power to declare that the posts of menteri besar and state executive councillors are regarded as vacant.
(However this was exactly what the Sultan did!!)

The ruler has defied the provisions of Article XVI, Clause (6) when he resorted to ordering the menteri besar to resign from his post when he has no power to do so.

VERY Interesting News you won't get easily!

The final moments of Mongolian Altantuya Shaariibuu before she was brutally killed in 2006 has been revealed in vivid details in a French newspaper today.

Journalist Arnaud Dubus, who traveled halfway across the world - from Kuala Lumpur to Ulan Bator, Mongolia and finally to Paris - for his investigation, unearthed a piece of documentary evidence exposing how Altantuya was allegedly killed.

The document - said to be obtained from a source in the Malaysian police - has not been revealed during the two-year-long murder trial of Altantuya. According to a lawyer who was involved in the case, the document which is a caution statement made by an accused in the grisly murder, could not be admitted in court after the law was amended.
In his report which appeared in left-wing Liberation newspaper, Dubus wrote that the document revealed "dry and precise descriptions" on how Altantuya was killed.Malaysiakini is unable to reproduce all the details of the document due to possible legal complications that could arise as a result of the on-going murder trial.

Last month, Shah Alam High Court judge Mohd Zaki Md Yasin set April 9 to deliver his decision on the fate Sirul Azhar Umar and Azilah Hadri - the two special action force police personnel accused of murdering Altantuya.The police document obtained by Dubus detailed on how Altantuya, who was referred as ‘the Chinese woman' in the document, had begged for her life, and stated that she had children, before she was shot.

It also mentioned that Altantuya was shot on the left side of her face, after which her clothes were removed from her body and put in a black plastic bag.
According to the document, Altantuya was shot another time when her hand was seen to be still moving.Altantuya was subsequently carried into the woods where explosives were wrapped around her legs, her abdomen and her head before she was blown to pieces.

The document clearly identified Altantuya's killers and the respective roles they played. Three months of investigationDubus told Malaysiakini that he spent three months investigating the case.
"I spent two weeks in Kuala Lumpur, then went to Ulan Bator where I stayed one week. Then, in Paris in January where I spent 10 days," he said in an email interview.
In his Liberation report, which was written in French, Dubus wrote about Altantuya's relationship with political analyst Abdul Razak Baginda and the role she played in the purchase of French submarines by the Malaysian government.

"In March 2005, Altantuya and (Abdul Razak) Baginda departed for Europe, touring France, Germany, Italy and Portugal in the red Ferrari of Baginda, staying in posh hotels and dining in the finest restaurants of the old Continent. "This trip, however, was not only for tourism: the contract for the sale of the submarines had been signed in 2002, but important details had yet to be settled," wrote Dubus.
"We knew that Baginda was used by Deputy Prime Minister Najib Razak as an intermediary for weapons systems deals, especially the high level ones," a regional security affairs expert had told Dubus.

Dubus also quoted Altantuya's cousin as saying that Altantuya and Abdul Razak were in Paris in March 2005, where they met with Najib."A picture taken at the end of March 2005 shows the three in a Parisian private club," he wrote, disputing a denial by Najib that he had ever met Altantuya.

He said that the story "turned dramatic" when in October 2006 Altantuya was informed that the commission paid by the French-Spanish company Armaris - which sold three submarines to the Malaysian government for one billion euros (RM4.7 billion) - had arrived at a Kuala Lumpur bank account.It was revealed that 115 million euro (RM541 million) commission had been paid to Perimekar, a company owned by Abdul Razak.

"Altantuya rushed to Kuala Lumpur, in order to claim her share of the commission from Baginda; she said she was entitled to US$500,000."Baginda and Altantuya broke up prior to this. A jealous Rosmah Mansor, the feared businesswoman and wife of Najib, objected any payment to Altantuya.

"Altantuya arrived in Kuala Lumpur with two other Mongolian women, one of them was a shaman responsible for putting a spell on Baginda if he refused to pay."For several days, Altantuya harassed her ex-lover. On Oct 18, Baginda could no longer tolerate the daily scenes made by Altantuya in front of his house," wrote Dubus.Subsequently, two police officers from the special unit tasked to provide protection to VIPs including Najib, were asked to "neutralise the Chinese woman."It wasn't a perfect crime

The case was not a perfect crime, said Dubus. Altantuya was kidnapped by the two police officers in front Abdul Razak's house."The taxi driver hired by Altantuya for the day did not appreciate that his passenger was kidnapped under his eyes without payment for the fare. He took note of the registration plate of the kidnapper's car and filed a complaint at the local police station.The police were able to quickly identify the car.

"Events unfolded that even the Deputy Prime Minister Najib Razak could not impede. He tried to cover the case. A few hours before the arrest of Baginda, he sent him a SMS:
‘I will see the inspector general of police at 11am today... 'The problem will be solved. Be cool'.
"A few hours after, Baginda was arrested as well as the two police officers, Azilah and Sirul."Abdul Razak was initially charged with conspiring in the killing of Altantuya but he was acquitted without being called to enter his defence. (and no appeal was made)

Dubus said that the case is not only embarrassing to Najib, who is linked to the case, but also DCNS - the French military shipbuilding company which bought over Armaris in 2007.
The 45-year-old French journalist, who is based in Bangkok, has written several books on Southeast Asian history and politics, including a book on the military in Indonesia and Thailand.According to him, his next book could be on the Altantuya case.

'I can prove Najib tried to bribe me'
An opposition politician today said he is prepared to go to court to prove his allegation that Deputy Prime Minister Najib Abdul Razak had offered him RM50 million to engineer at least two defections in Perak.

Ipoh Barat division chief Fauzi Muda said since the police and the Malaysian Anti-Corruption Commission (MACC) are serious about investigating his statutory declaration, they should either charge him or Najib. "I challenge them to charge me. I am prepared to go to court to reveal all the evidence that I have including a recording of my conversation with Najib. I challenge the police to charge me as I know the police and MACC will not charge Najib "If they charge me, it will be the best way for me to face Najib in court and reveal all the evidence that I have," he told reporters this morning after filing a MACC report in Ipoh. Fauzi is seeking the MACC's help to stop the police from 'intimidating and harassing' him over his statutory declaration.

Why are the cops involved? The PKR leader also expressed surprise over the police's involvement in the matter, accusing them of acting beyond their duty since there was no report lodged by Najib or his representatives against him. "In fact, the police have been instructed to act on my statutory declaration. I was instructed to come to the Ipoh police station on Feb 10. Following that, the police contacted me many times for me to come and they took further statements."On Monday (March 2), I was asked to report to the serious crimes unit in Ipoh where they took more statements. What is the motive for the police in this case as I made the report to the MACC?" he asked.On Feb 2, Fauzi made a statutory declaration that Najib had offered RM50 million to him - when he met the deputy premier at his official residence on March 11, 2008 - to arrange the defections before Pakatan Rakyat menteri besar Mohd Nizar Jamaluddin came to power.

Fauzi said the recent defections of Pakatan Rakyat state reps, leading to the change in state government, was strong proof in relation to his allegation against Najib. Following his declaration, a report was lodged with the (MACC) by PKR Youth chief Shamsul Iskandar Mohd Akin on Feb 4.On the same day, Fauzi said, the three Pakatan Rakyat assemblypersons (two from PKR, and one from DAP) had declared their defection before Najib and to support BN.

In his statutory declaration, Fauzi also claimed that former deputy defence minister Zainal Abidin Zin brought him to Najib's official residence where he was offered the money. Zainal Abidin later admitted taking Fauzi to meet Najib but denied that any monetary offers were made.

According to the post-mortem report, the beating caused a breakdown in Kugan's muscle cells, which then congested the blood flow which in turn caused a kidney failure.The pictorial evidence also showed that Kugan suffered from massive internal bleeding due to severe beating.The independent post-mortem report was commissioned by Kugan's family after they were dissatisfied with the report tendered by the Serdang Hospital authorities that Kugan had died due to liquid in his lungs.

So the question is...who could have beaten Kugan to death??!?! (afterall he was under the protection of the police what!)

And the answer is....!!!!!!

Herald editor says ban on ‘Allah’ lifted with conditions
A church official says the government has lifted a ban on the use of the word "Allah" by Christian publications.
Rev. Lawrence Andrew, the editor of the Catholic Church's Herald newspaper, said today the Home Ministry is allowing the publications use "Allah" to refer to God as long as they state that the material is only meant for Christians.
The controversy first broke out in late 2007 when the government banned the use of “Allah” in Christian Malay-language texts because it allegedly might confuse Muslims.
The Herald has challenged the ban in court and argued the Arabic word is a common reference for God that predates Islam and has been used for centuries as a translation in Malay. — AP, 26 Feb 2009
The High Court has set May 28 for hearing in the suit taken by the Catholic Church against the home minister and the federal government in which the church does not want any parties to intervene in its case over the use of the word "Allah".
Justice Lau Bee Lan, of the Appellate and Special Powers Division, also set July 7 to hear the arguments by several state Islamic councils to transfer the case to the Federal Court. — The Malaysian Insider, 27 Feb 2009
On 16 February 2009, the Home Minister, Syed Hamid Albar, signed a gazette known as Gazette PU A 62 under section 22 (1)(c) of the Internal Security Act 1969 -- titled Internal Security (Prohibition On Use of Specific Words on Document and Publication) Order 2009.
The gazette states as follows: Prohibition on use of specific words on document and publication 2. (1) The printing, publication, sale, issue, circulation and possession of any document and publication relating to Christianity containing the words “Allah”, “Kaabah”, “Baitullah” and “Solat” are prohibited unless on the front cover of the document and publication are written with the words “For Christianity”.
(2) The words “For Christianity” referred to in subparagraph (1) shall be written clearly in font type Arial of size 16 in bold.
A spokesman from the publication and Quranic text division of the Ministry said he was unaware of the gazette and would check with its legal division. A Christian church leader said this matter should first be discussed before made into law, as the churches are not even aware of this new ruling.

He expressed surprise that this new gazette has prematurely come into force when there are two cases before the courts to argue the constitutionality of the earlier prohibition by the ministry. The Catholic Church is suing the government over its insistence that they cannot use the Allah word in the Bahasa Malaysia section of their weekly publication.
The Sidang Injil Borneo Sabah (Evangelical Church) is also suing the government over confiscation of their Christian publications imported from Indonesia, which contain the word Allah.

Previously, the Home Ministry, in an out of court negotiation, had suggested that churches stamp the word “For Christians Only” on the Al Kitab and their Bahasa Malaysia publications. But this was not acceptable to the churches, which had counter-offered with the phrase “This is a Christian Publication.” The Ministry, however, rejected this counter-proposal.
PKR’s Member of Parliament for Bandar Baharu Kulim, Zulkifli Nordin, is also up in arms about the matter. And this is his response to the matter:

“Have they referred to the related decree? The ministry should not compromise on this matter. We should look at the social context where the word is used by the Malay Muslims in the country, what is the reason behind their insistence on using ‘Allah’. I am worried that the word ‘Allah’ was used with the aim to confuse the Muslims. Does God’s name follow the race or language? I have no problem with the use of the Malay language, but by using the word ‘Allah’ to refer to God, it made the Muslims unhappy, I have met a lot of them who told me this.”
Were you aware that it is a crime for non-Muslims to greet Muslims with the phrase ‘Assalamu Alaikum’? It is also a crime for non-Muslims to use words such as insha-Allah, masha-Allah, Alhamdulillah, and so on. There are about half a dozen ‘banned’ words that non-Muslims may not use in their daily communication, basically all words that contain the word ‘Allah’.
About twenty or so years ago, the MCA chief for Kuala Terengganu, Wong, would speak to his Malay friends as if he was a Muslim. If you had your back to him when he spoke you would have thought that a Malay was speaking. Imagine your surprise when you turn around to find a Chinaman speaking better than even Malays could.

Wong was very free with words like insha-Allah, Alhamdulillah, masha-Allah, etc. And the Terengganu Malays loved him for that. When he contested the Kuala Terengganu state seat in the 1990 general election, he lost to the PAS candidate, Ustaz Haji Harun Jusoh. Wong won all the Malay votes at Losong and Pulau Kambing. However, he lost the Chinese votes from Kampong Cina who voted for Ustaz Harun.

Malays like to call Chinese Muslims mualap (mualaf). When I went to China more than 15 years ago I visited the oldest mosque in China. It was at Kwangchow (Canton) and was built 100 years after Prophet Muhammad’s time. That’s right, the Chinese were Muslims 700 or 800 years before the Malays and when the Malays were still Hindus, Buddhists, tree worshippers, and so on. But only the Malays are true Muslims while the Chinese are mualaps.
I met the Imam of the Kwangchow mosque and he spoke to me in Arabic. I replied, “Mafi kalam Arabi.” He was surprised because I just did my prayers in the mosque, which he assumed I would have performed in Arabic.

“You don’t speak Arabic?”
“No,” I replied.
“You can read the Quran?”
“Yes,” I replied.
“You can read the Quran but you can’t speak Arabic? How do you do that?”
“I recite only, not read.”
“So you can’t understand what you recite?”
“No,” I replied.
“What kind of Muslim are you? You recite the Quran but can’t understand what you are reciting.”
“Well, I am the same as 99% other Muslims in Malaysia. We all don’t speak Arabic and can’t understand what we are reciting.”
The Imam shook his head and went off to pray for God to have mercy on me -- and the 99% other Malay Muslims in Malaysia.

The word Allah is already in the Bible. It is exactly the same word that the Jews, in Hebrew, use for God (eloh), the word that Jesus Christ used in Aramaic when he prayed to God. In Hebrew, Huwa el Elah or HUWA 'L LAH means HE IS ALLAH in the verse QUL HUWAL LAH HU AHAD.
"My God, my God, why hast thou forsaken me?” said Jesus on the cross. In Aramaic this is: "Eli, Eli, l'mana Sabachtani?"
The words El, Elah and Elohim are not three distinctly different words. They all represent the single Arabic word, Allah, which is also the same in Hebrew.
No, Islam does not have monopoly over the use of the word Allah. The Christians and Jews too use this same word. In fact, the biggest ‘selling point’ for Islam is that the Quran recognises all the Prophets of the Jews and Christians and that we all pray to the same ONE God, Allah. If the God of the Jews, Christians and Muslims is the same one God, would not then the name of this God also be the same? How can the name of the Muslim God be different from that of the Jews and Christians if we all pray to the same one God?
Some Malays, PKR and PAS Malays included, are very narrow-minded and ignorant. And this is because they recite the Quran like parrots without understanding what they are reciting -- mainly because they do not speak the language of the Quran. And, for sure, they do not read any of the Holy Books of the other religions because they are of the opinion that it is forbidden (haram) to do so. It is said that even Prophet Muhammad sought advice from his wife’s, Khatijah’s cousin, Warakah, a learned Christian scholar of his time, though some scholars refute this (but they do admit that Warakah was a Christian who attended Prophet Muhammad’s and Khatijah’s wedding).
And Prophet Muhammad never prohibited the Jews and Christians from using the word Allah. But then Malays think they are better Muslims and more learned than the Arabs even though Malays recite the Quran without understanding what they are reciting -- unlike the Chinese Muslims in China. And what are 16 million Malay Muslims compared to the more than 100 million in China, the mualaps, as the Malays would call them, who have been Muslims since 1,300 years ago when Malays were still praying to trees and whatnot.
