6 PSM released!


The Parti Sosialis Malaysia (PSM) 6 have been released today after they were detained since July 2 for undefined charges during the Bersih 2.0 crackdown.

azlanIt is understood that they were released at 5.30pm at the Jinjang police station, following public outrage and sustained protests over their arbitrary detention.

The six PSM members - Choo Chon Kai, Sarat Babu, M Sarasvathy, M Sukumaran, A Letchumanan and Sungai Siput parliamentarian Dr Jeyakumar Devaraj - were initially detained on suspicion of planning to wage war against the King.

It was learnt that the charge was however changed several times, at one point accusing them of being ringleaders of the Bersih 2.0 rally on July 9.

In a short statement issued to the media, inspector-general of police Ismail Omar confirmed the release of the six from detention under the Emergency Ordinance.

“Following their release, further action will be determined by the attorney-general's chambers,” he said in a two-paragraph statement.

Jeyakumar had yesterday began his hunger strike yesterday, putting additional pressure on the police.

NONEWhen contacted, PSM secretary-general S Arutchelvan and their lawyer Edmund Bon confirmed that the six were released at 5.30pm.

In an immediate response to the release of the PSM 6, DAP advisor Lim Kit Siang said the authorities should take responsibility for detaining the six with bad intentions.

“Informed PSM6 released by police. Victory of people n reason. Hishammuddin/IGP shld apologise 4mala fide detention. Najib shld repeal EO,” he said on a Twitter posting.

The PSM 6 later appeared in a 'victory celebration' at 7.30pm at the KL-Selangor Chinese Assembly Hall.

Police raided the home of blogger Chan Lilian in Penang and carted away her 27-inch iMac and a modem yesterday as part of their investigations into a tweet she sent last month.

Chan, a videographer, is being investigated under Section 4 (1) of the Sedition Act for her tweet message, as well as Section 27 (5) of the Police Act for allegedly participating in the July 9 Bersih 2.0 rally in Kuala Lumpur.

azlanIf convicted, Chan faces a jail term of up to three years, a fine of not more than RM5,000, or both.

Yesterday, four police officers from the cyber crime unit in Brickfields, Kuala Lumpur, questioned Chan for about an hour at the Jalan Pattani (northeast district) police headquarters in Penang.

They then went to her house in Tanjung Bungah and spent two hours searching for "evidence".

They also combed through eight files on her computer, took snapshots of her Twitter account and drew a diagram of her work area.

The police team, led by investigating officer ASP Ridzuan Ibrahim left about 8.30pm with Chan's iMac and a modem.

Asked by journalists about the seizure of Chan's prized iMac, Ridzuan replied, "No comment!" before slipping into the police car.

Chan was accompanied by lawyer Tham Shien Shyong during her three-hour ordeal.

"I maintain that I have no intention of inciting anyone - my tweet is restricted (to 900 members) but its privacy has been abused," added the mother of four.

"It is regrettable that this has happened. I tweeted as an individual and a blogger, and this has nothing to do with where I work (or my employer)," she said.

900 members in Twitter account

On June 29 night, 10 days before the Bersih rally, Chan had sent out a tweet suggesting that Christians march to protest their "persecution".

This resulted in a police report being lodged against her by Blog House secretary Tony Yew.

In his report, Yew alleged that Chan's tweet contained seditious elements, which directly incited Christians to go against the government.

Yew, who was one of Chan's 900 members in her Twitter

account, said that as a Christian, he believed the tweet message has "the ability to threaten the security of the nation".

He had also wrote in his blog that Chan's tweet was re-tweeted and he was disappointed there were people out there happy to spread the word.

Chan, a former Malaysiakini citizen journalist, said her Twitteraccount was restricted to her followers, but she had unknowingly added Yew.

In his July 1 blog post titled "Don't push it", Yew says he made the police report against Chan as his warning to her to remove her allegedly seditious tweet had been ignored. "I guess now it's time I did my part to debunk the notion that ALL CATHOLICS are off (sic) the view that we have been religiously persecuted," he says in the posting.
I am appealing to all right minded (not like minded) people to think rationally and not react emotionally. "Malaysia is OUR COUNTRY, and do not let the likes of (Perkasa chief) Ibrahim Ali, or (Bersih 2.0 chief) Ambiga (Sreenevasan) and those bent on tearing Malaysia apart for their benefits to prevail."

In another blog post titled 'Bersih, a gathering for what?' published on the same day, Yew urges the police to investigate Chan and charge her with sedition.
'We must all be vigilant in safeguarding this nation'
He asks that police use her as an example for others, so that no one would take National Unity for granted.

"As long as there are those out there who think they can get away with this, then we must all be vigilant in safeguarding this nation we all love," he says.

WHY DOES THIS TONY SOUND SO MUCH LIKE AN UMNO GOON?!?!
WHAT IS HE HOPE TO GET FROM THIS??
IS HE BLIND TO SAY THAT CHRISTIAN ARE NOT PROSECUTED IN THIS COUNTRY?!?
Maybe he does not go to church enough, or has never tried applying to the authorities for permission to build anything on behalf of the church before!

Justice done but still undone! TBH!

Why!? After reading certain section of the RCI Report on TBH, I can see that the RCI really shot the MACC really bad! But after everything they said, they still think that TBH committed suicide?!? Makes no sense!

Just to give you an idea, the following is what the RCI said in their report.
1. They said that the MACC officer interrogation was aggressive, relentless, oppressive & unscrupulous.

2. He was involuntarily escorted to the MACC building where his mobile was confiscated and his lawyer was denied access to him.

3. He was then verbally assaulted by a pack of 6 officers!

4. RCI called this an inhumane treatment which TBH and to endure (this torture) for 4hours! Worst still this was only the first of 4 interrogation stages which TBH had to go through!


5. Arman and Ashraf (MACC Officers) instilled fear and doubt in TBH through false statements!!

6. Arman & Ashraf (A&A) were either stupid or in a deplorable act, they intentionally exploited TBH lack of knowledge deliberately with the aimed to confuse TBH.

7. A&A force TBH to disclose the password to his private e-mail account which is a gross violation of a person's right

8.The RCI Report said: "Arman was certainly a bully..." and found Ashraf evidence most unreliable.

9."...threats of physical harm were most probably used by A&A when interrogating him"

10. In the 3rd interrogation, Nadzri (another MACC Officer) deliberately prolonged this process to torture TBH mentally and disorientate him to agree to turn against his boss out of despair.

11. RCI also mention that what Selangor MACC did was not only inefficient wok but also illegal!
And these actions by the MACC officers cause TBH to commit suicide.

12.Contrary to what MACC reported, RCI believe that TBH was not released. He was still under detention by the Selangor MACC.

13. The main MACC officer incharge called Hishammuddin Hisham (HH)... RCI had this to say about him.
"...We found him to be arrogant, given to falsehoods, untruthful and uncompromising in his stand. His falsehood, particularly of his nonactive involvement in the entire operation at the material time, were exposed from the contradictory statements he made before us. But more compelling was the confirmation from 2 of his own officers,..."
14. Read how RCI further describe this HH guy...
a. "We were unable to accept the testimony of HH ..as the truth..."
b. "No reasonable man would be able to accept as true the story of HH.."
c. "No person in their right mind would believe HH...."
d. "...HH was just to stubborn to retreat from his mistake... To overcome his disappointment at the negative results....he must have resorted to a personal and more aggressive interrogation of TBH..."

THIS GUY IS THE...Deputy Director of the Selangor MACC at that time, holding the rank of senior assistant commissioner 1 and with MACC for 19 years!
He is currently the Director of MACC N.Sembilan...
NOTE THE PROMOTION!!!!

RCI also mention that the expert called in (Prof Mullen) said that TBH was firmly in the lowest risk group for suicide when he was taken into MACC custody!
According to the other expert brought in (DrBadi'ah and Dr Hayati), TBH came from an intact family and had a stable job. Having no history of mental illness, impulsivity or substance abuse, TBH would be in the low-risk category for suicide. In fact he was looking forward to his wedding and his fiancee was then pregnant.
RCI also mention that based on family and friends, TBH was hardworking, diligent, responsible, devoted to his family, loved children, and was faithful to his boss.

We (RCI) note that TBH 's relationship with his boss, YB Ean, was a mutually cordial and respectful one.

Based on the RCI report it is clear who killed (directly or indirectly) TBH!!!

We must demand from the government that justice to be serve!!! NEVER FORGET!!! NEVER LET THE GOVERNMENT FORGET!!!

WE MUST DEMAND CLEAR ACTION FROM THE GOVERNMENT!
Let what happen to TBH and Ahmad Sabani never again happen to anyone in Malaysia!

Why do you fear a guy that looks like Mr Bean?!?


PETALING JAYA: Prominent French human rights lawyer William Bourdon will be deported tonight after being detained for more than four hours by immigration and police officials at the Kuala Lumpur International Airport (KLIA).

Bourdon has been served the deportation order and he will be leaving Kuala Lumpur at 11.30pm along with his wife Lea Forestier to Paris.

Bourdon, in a brief statement, said that the Malaysian police had ordered him to leave the country as soon as possible.

He said when he explained that his return ticket to Paris was only on Sunday, he was told that he would be detained until then.

“We have decided to find the earliest return flight possible at our own costs. I don’t understand this decision as no explanation has been given to me so far,” he added in his hand-written note (photo, below).

“I hereby declare that I have acted as the lawyer for Suaram in full respect of my duties and rules and in perfect compliance with national and international laws.

“I consider that this deportation decision is a breach in the right to freely exercise my profession as a lawyer,” he said.

Bourdon had arrived here from Penang, where he spoke at an event organised by rights group Suaram regarding the controversial Scorpene submarine deal. He was scheduled to give another speech tonight in Petaling Jaya on the submarine scandal, followed by another in Ipoh tomorrow.

But when his Malaysia Airlines flight landed at 11.40am, three immigration officials came on board to escort him off the aircraft. Bourdon was taken to the holding centre where he was questioned for four hours.

Suaram executive director, Cynthia Gabriel, who is at the KLIA, told FMT that she managed to speak to Bourdon and that he was being held in the Immigration Enforcement Division.

“The officials asked him to sign deportation papers in Bahasa Malaysia and of course he refused,” she said. “The French Embassy officials are currently in negotiations with the immigration officials. But the Bourdons are definitely going back to France tonight.”

Meanwhile Fadiah Nadwa Fikri from Lawyers for Liberty (LFL) said that Forestier was released earlier and that she was on her way to the division where Bourdon is being held.

“He has been denied access to lawyers which is ridiculously absurd. And none of the officials have issued any statement on the grounds for his detention.”

According to Fadiah, Forestier was “very shocked and upset over the arbitrariness of situation.”

“Only other experience of William and I denied entry was Tunisia under BenAli… there was a banana republic!,” Forestier was reported to have said, according to tweets from local activists.

The authorities also failed to acknowledge the fact that Bourdon was Suaram’s lawyer on the submarine case and that his deporation would be a breach of his right to perform his duty as a lawyer.

Subang MP Sivarasa Rasiah, and Batu MP Tian Chua, are also at KLIA but their attempts to meet with Bourdon have been denied.

The submarine deal

In June 2002, the Malaysian government signed an agreement with French DCNS and Spainish Navantia for the procurement of two Scorpene class submarines.

The procurement contract was through direct negotiation with the manufacturing companies, said to be with the service of Perimekar Sdn Bhd, linked to academic Abdul Razak Baginda.

The Scorpene issue had been mired in controversy with allegations of kickbacks and linked to the murder of Mongolian national Altantuya Shaariibuu.

Razak, a close aide of Prime Minister Najib Tun Razak, was charged with abetting the murder but was later acquitted.

The controversy had even forced Najib to swear on the Quran to clear his name.

The French authorities are currently probing the deal.

In December 2009, Suaram filed a complaint with the French courts asking for access to information regarding government contracts signed with Perimekar and other information classified as official secrets in Malaysia.

In April 2010, the French courts accepted the request to investigate the claim of corruption for a payment amounting to 114 million euros from DCNS to Perimekar.

It is believe that with his deportation, Bourdon will not be available to be a key speaker for Suaram fund-raising dinner in KL tonight.


Who's work is this!? Immigration?!? On what grounds?!? Innocent people have nothing to fear or hide! So who is scared of this French lawyer? Only the guilty!!! Only the guilty!

While Bersih took center stage.....

UMNO had their own street demonstration in Penang and they got away with it!

During the protest, some 300 supporters from Umno, Perkasa and an unregistered NGO Suara Anak Anak Mamak Pulau Pinang held a noisy march and a violent demonstration in the city centre, condemning both the Pakatan state government and the Bersih 2.0 rally.

Chanting anti-government and anti-Bersih slogans, the rioters marched between Masjid Kapitan Keling and Komtar against the traffic flow causing traffic to come to a standstill.

The rowdy protesters hit the windshields of cars, violently shoved media personnel and intimidated panic-stricken passers-by and motorists.


The rioters even threatened to throw reporters off the bridge. Their illegal demonstration near the middle span caused a massive 10-km long traffic congestion on the island.

Where were MCA, Gerakan and MIC in condemning these actions?!?!

Why were there no on, or little media coverage condemning these actions??!?

Was there any Police with tear gas or water cannons??

Why did the HomeMinister not condemn these NGO and made them illegal??

Will these violent demonstrators get away with it?!?

This is how fair our BN govt is! Remember this the next time you vote!!

The six detainees are Sungai Siput MP Dr D Michael Jeyakumar, PSM deputy president, M Saraswathy, central committee members Choo Chon Kai and M Sugumaran, Youth chief R Sarathbabu and Sungai Siput branch secretary A Letchumanan.

They were initially charged under Section 122 of the Penal Code for waging war against the King late last month but was then release and then immediately arrested under the EO.

If they have broken any laws, then charge them in court and give them a free and fair trial! But Malaysia is not a Police State!!


On another note! Why does it take 30 Policeman to catch this guy?!?! Who is he!?!? A murderer?? A rapist?!?!

Its also gets boring after a while. However recently Chua Soi Lek and Lie Tiong Lie comments are so beyond stupidity that I have to make an exception lah!

1. Stupid Health Minister tried to cover up for the police by saying that wind had blown the tear gas into the hospital and chemical-laced water only brushed the edges of the hospital walls as a result of police action against Bersih 2.0 supporters. How stupid can he get?!? Does he not know that there are numerous Videos and Photographic evidence!?? Dumbass!

What angle?!? Are you talking about! Hei! This is not one of your sex video you are shooting ok! Your statement is even worst than Mr Lie Tiong Lie!! What kind of party is MCA that they can have 2 idiots like this as their leaders??!


Background of this statement.
The Entertainment and Entertainment Premises Enactment was passed 14 years ago, in 1997, when Kedah was under the then Umno-dominated BN state administration.

This Enactment banned all entertainment outlets in the state from conducting their businesses during the Muslim fasting month of Ramadan. This law was never enforce till the PAS led govt tried to apply this law for this coming Ramadan.

Chua Soi Lek then came out to shoot the Opposition saying that the ban as disrespecting the rights of non-Muslims and said that it would affect their daily lives.

DAP also oppose this law and recently PAS compromise to allow only Muslim to enter only certain entertainment outlets while non-Muslim are free to do as they please.

What did MCA said in their statement?

...in its statement, MCA admitted that the enactment was indeed passed by the BN-led government, but that the law was never enforced. "I would like to stress that the BN state government in Kedah of that time had never implemented these policies that affect non-Muslims. "The BN state government had confidence that non-Muslims will have mutual respect for the Muslim way of life," read the statement by the Chinese-based party's state chief Chong Itt Chew.

The stupid MCA leaders asked DAP to make a stand on this issue but they didn't have the balls to reject or make a stand on this law when it was first table 14 years ago?!?!

What is the point of passing a law that is not going to be enforced?

Shows us what kind of dumb lawmakers we have in MCA!!!

This is enough for me to say I rather have another race represent me in parliament than these dumbos!! This is not politics!! This is just plain common sense!!

He fought for his country's freedom!

Police say he died of a heart complications and he had overexert himself running. But why was he running? Away from who? Why did he even needed to run? Did the police really need to charge the crowd? Did they need to shoot the water cannons and tear gas at the crowd?

We must pray for justice! For those responsible for his death to come to justice!

July 9 - the day when the people rise up


COMMENT That's it! Bersih finally has had enough of the treacherous conduct of a shameless government which has lost all sense of decency!

In a firmly worded statement released late last night, Bersih effectively said "come what may, we will have our rally at the Stadium Merdeka on July 9 at 2pm!".

This is Bersih's final answer to a battery of ridiculous obstructions, warnings and excuses put up by the Najib government to obstruct a Bersih rally in the stadium.

This is despite Bersih having made a major concession to shift the rally from the streets to a stadium under the unprecedented intervention of the Yang di-Pertuan Agong, and after Prime Minister Najib Razak's offer of a suitable stadium for the purpose.

And the 360 degree turn by Najib and his government happened within a day!

Impasse resolved?

It was only on Tuesday (July 5) afternoon that Bersih had an audience with the Agong during which it accepted the government's

rally-in-stadium offer to resolve the tense impasse between Bersih and the Najib government, during which an obviously panic-stricken government went on a rampage of wanton arrests to deter an anticipated massive street rally.

Upon Bersih's announcement to stay off the streets, Najib immediately expressed readiness to meet Bersih over a suitable stadium for the purpose.

The next day, Wednesday July 6, Bersih indicated it wanted the event to be held at Stadium Merdeka due to its historical significance and central location.

Bersih further said that it had ascertained the stadium's availability

But Umno Youth immediately said: "We reject Stadium Merdeka for Bersih. It is not a place for political gatherings. Do it in a Pakatan Rakyat controlled state."

This was followed by the stadium management's rejection of Bersih on the blatantly false excuses of "internal management sports event" and "renovation".

What did the prime minister, who had earlier suggested and agreed to the rally-in-stadium proposal, have to say about the rally in Stadium Merdeka?

He said it was up to the authorities in charge of such matters to act in accordance with requirements of security and safety.

He emphasised, however, that "permission would only be given to organisations that are registered, but Bersih has never been registered, it is an illegal organisation".

He gave no indication whether approval to use the stadium would be forthcoming.

Then, Home Minister Hishammuddin Hussein, who had earlier declared Bersih illegal, made the shocking and puzzling announcement that

Bersih is still illegal, despite the impasse being resolved in accordance with the wishes of the prime minister, mediated by His Majesty the Yang di-Pertuan Agong.

Hishammuddin said: "They are still banned. Nobody can put themselves over the law. Just because Tuanku met them, doesn't mean they are no longer illegal".

However, despite the alleged illegality, Hishammuddin made the curious statement that Bersih could still apply to the police for a permit to hold the rally, but gave no assurance that a permit would be given.

Bersih is betrayed

Finally, Bersih's door to a stadium rally in Kuala Lumpur was shut when Information and Culture Minister Rais Yatim announced that the Cabinet has decided to bar Bersih from holding its rally in any of the stadiums in the Kuala Lumpur area.

Rais suggested that Bersih could hold its rally in a Pakatan -controlled state.

Meanwhile, the police crackdown on Bersih supporters continues unabated, arresting any one seen wearing a yellow shirt or any paraphernalia linked to Bersih.

So far, there have been more than two hundred arrests, including members of parliament and state legislative assemblymen.

Some are being charged in court, and some are detained under the draconian Emergence Ordinance which provides for indefinite detention without trial, which has been traditionally used against vice criminals.


Ministers and police have warned that even when a stadium rally is approved, anyone wearing anything suggesting support for Bersih including the yellow T shirts will be arrested.


So, Bersih was played out!


It gave up the street rally out of respect for His Majesty and in compliance with the PM's wishes; but in return, it was denied a stadium for rally, and its supporters continue to be hunted down and persecuted like criminals through massive abuse of police power under fallacious legality.


Hishammuddin claimed that Bersih is illegal because it is not registered with the Registrar of Society, and hence any article or any activities promoting Bersih is also illegal, hence the mass arrest.


But this is pure legal nonsense.


Bersih is a temporary and loose grouping of registered NGOs (62 in at this moment) which have come together for the specific task of pursuing electoral reforms.


If these NGOs are by themselves legally registered bodies, how can they become illegal just because they have joined forces to pursue a transient objective?


If Bersih is decreed illegal, then all the NGOs in this group must also be deemed illegal. So are the members that belong to these respective NGOs.


By extension, any grouping of registered bodies who have joined forces to pursue any joint objective must also be considered illegal, including the opposition alliance of Pakatan Rakyat, which consists of PKR, PAS & DAP.


Why hasn't Hishammuddin banned Pakatan Rakyat, and decreed their joint pursuits as also illegal?


Can Hishammuddin explain the strangest logic ever known - as reflected in the police arresting individuals bearing symbols of Bersih, when the organisation itself was sanctioned by the PM through the offer of a stadium to conduct its function?


Isn't the entire Barisan Nasional government - PM, cabinet, police and judiciary - making a fool of themselves by crucifying and persecuting a well-meaning civil society movement on the premise of a fictitious law?


Greatest disrespect to Agong


By insisting that Bersih is an outlaw, after it has reached a settlement with the PM under the auspices of His Majesty, hasn't Hishammuddin shown the greatest disrespect to the two highest leaders of the country?


And hasn't PM in turn made a mockery of His Majesty's gracious

NONE

effort to bring reconciliation and good sense by failing to keep his end of the bargain to allow Bersih to hold its rally in peace?


In the midst of such treasonous conduct from our leaders, we wish to congratulate Bersih for its courage and determination to do what is right. In its statement signed by all the 14 members of its steering committee last night, it said:


"As members of civil society that are committed to principles of integrity, we fully intend to abide by the advice of Tuanku DYMM SPB YDP Agong and hold our gathering in a stadium to state our demand for clean and fair elections.


"Whether or not the government abides by their principles, we, the Malaysian people, will always uphold ours. Our determination to exercise our constitutional right to gather peacefully for a just and reasonable cause is unwavering."


Now that Bersih has conducted itself with honour, we the people must respond likewise.


It is about time that we stand up to reclaim what is due to us - our liberty and dignity and our right to determine our future, as enshrined in the Constitution.


Let everyone come out wearing yellow, and let the traitors be swarmed and drowned by a sea of yellow in Kuala Lumpur on that day.


Let July 9 be remembered in generations to come as the day when Malaysians finally rose up to reclaim their motherland from the grip of a tyrannical power.
